Tribunal

I may be not posting for a few months as I am doing a Tribunal

case and need to gets lots of expert reports and so on. Found out yesterday

that I can get legal Aid for preparation!! previously, the rules meant I

couldn't. Still have to find £X k for representation and witnesses, though.

(Automatic right to legal Aid if on Income Support even if you have capital in

the house in which you live - I'd better not get a job till it's over!.) Time

limits are now against me, as the Appeal has already gone in - only 6 weeks to

do everything.

Dear Caroline,

no improvement yet in his behaviour, but I'm hoping! he has a rotten cold and is soooo cranky. I've been trying to instruct solicitors since Monday - they're so busy, they haven't responded to e-mail or telephone calls. But they are specialists with an excellent reputation, and it's a waste of time going to a dabbler.

Have you submitted the report to tribunal which points out the faults in the eclectic model of teaching that these special schools operate?

Hi Sara

I think that the LEA have to be seen to be offering a provision that

is 'reasonable ' for your child.... this is in itself v wooly but

as we understood it, it doesn't have to offer the all, singing

dancing model but one that is reasonable for your little one.

We live in cheshire and were heading for tribunal to get ABA instead

of a special school. We had Conrathe, solicitor and

Urani, an Ed Psych. Both v talented and know their stuff. Having

shown Urani the LEA's intended provision, we were advised by

him and Conrathe to pull out at the last minute as the special

school on offer was indeed 'reasonable' (actually Urani said it was

one of the best special schools that he'd ever seen) for our son.

But we had already started ABA by then and it was obvious to the ed

psyche (and us) that wasn't going to be one of those kids who

get thru all the programmes at the rate of knots. He's now 7 and

non verbal..... So what I'm trying to say (but not v well) is that

IMHO alot depends on whether LEA provision is 'reasonable' for your

particular child's needs, and every child is unique and must be

treated as their own special case.

Sara, I persume you’ve been doing AbA/VB and can prove that it has worked for your child and you have reports to back this argument. The LEA can argue that their model is adequate for your child, but you need to go in argue that your child is too young for this special school (you say it’s mainly key stage 1) and that your child is unlike the other children (you seem worried that they are all high functioning). Point out to tribunal that you know your child better than anyone and argue the point that your child could regress in the wrong teaching environment. (Our children are at risk of this). As for Urani and Conrathe suggesting parents pull out (Helen below), I’ve heard this said to many parents(honest) before and they ignored this advice and went on to win at tribunal. Don’t pull out. Go in and fight for what you believe is right for your child. Tell them how ABA/VBA has helped your child progress and point out that your child could regress (as all our children can) in this special school. Have you submitted the report to tribunal which points out the faults in the eclectic model of teaching that these special schools operate? Your child is only 4. Still very young. You’re in for a good chance to win this.

Ps Won a tribunal in 2006,got taken to High Court by LEA lost that and took LEA back to tribunal and won again.

Hi Sara and Gillian

I think what Gillian says above is key to what you value your

chances at winning are. We took Urani and Conrathes's advivce and

did pull out BUT having compared the test scores at entrance to

doing ABA and 18 months later, hadn't progressed v much at

all and the LEA will take this into account when offering

their 'reasonable' provision.

If your child can be seen to have progressed then thats a whole

different ball game. Most kids doing 40 hrs a week do and george was

doing 40 hrs but he is (and continues to be ) v severe which we are

now tackling biomedically under Jean's expert help!

Good luck. If you don't think its the right provision for your

child then fight tooth and nail.

The post code lottery plays it's role again this is exactly the type of

unit I wanted for 2 years ago but could not get! And here you are

being offered it when it may not be appropriate at all. Special Needs

Education system stinks. Sorry I can't be more helpful but I do know

just how stressful tribunals are so my thoughts are with you.

Hi Sara

We weren't exactly in the same position. Charlie turned 4 in July

2005 and I really wanted to keep him on at nursery for another year.

We had just toilet trained him and he had very limited vocabulary. He

couldn't answer questions apart from thoses from a year of ABA - " how

are you " was answered with " Im fine " or I'm four years old!

Anyway the LEA wouldn't budge and a local school had a good

reputation with SEN kids ( they have quite a few blind children) so

we went to see them. I was in a total panic and the statement only

said band A. The head teacher was fab and got that changed to band B

straight away.

Charlie could do very little in his first year and did not talk much

but his TA's were great - I talk to them every day. With biomed and

diet Charlie has improved alot and copies the other kids.

What I'm trying to say is that although it is terrifying if the

mainstream is good and the teachers/ta's decent people then I believe

if your child hasn't got too many sensory issues ( ie can cope with

all the kids and noise) then they are much better off in mainstream.

I think it is the sensory issues that stop our kids integrating the

most. This mainly went away with diet for Charlie - though good old

yeast lets it fare up now and again.

The LEA are always going to be against you but if the school is good

then you don't have to deal with them. Our TA even gives Charlie his

charcoal at the right time and I don't have to sign any forms.

They have had other ASD kids with more sensory issues but thet have

coped fine and so has the school. Get the school's record on how many

ASD kids have failed there and had to go to special schools - non has

at our school.

Now if you know any good drs or paeds - I have totally failed there!

I know i have gone on about our school but I hope I have made some

sense.

I asked my legal rep for advice on this and she said this is happening

more and more. She asked if they had therefore changed their witness

(assuming the LEA were calling a witness??). She felt that an

adjournment was probable. What representation do you have currently?

This has been my experience. Mainstream was positive with normal

children modelling desirable behaviour, urgently demanding that my

daughter respond to them, firm, positive LSA and teachers. It was good.

Special school (for us) was badly managed, inconsistent, clueless, with

low expectations and poor staff. In other words it's the quality not

the type of provision.

I think what Gillian says above is key to what you value your

chances at winning are. We took Urani and Conrathes's advivce and

did pull out BUT having compared the test scores at entrance to

doing ABA and 18 months later, hadn't progressed v much at

all and the LEA will take this into account when offering

their 'reasonable' provision.

If your child can be seen to have progressed then thats a whole

different ball game. Most kids doing 40 hrs a week do and george was

doing 40 hrs but he is (and continues to be ) v severe which we are

now tackling biomedically under Jean's expert help!

Sara, I

persume you’ve been doing AbA/VB and can prove that it has worked for

your child and you have reports to back this argument. The LEA can argue that

their model is adequate for your child, but you need to go in argue that your

child is too young for this special school (you say it’s mainly key stage

1) and that your child is unlike the other children (you seem worried that they

are all high functioning). Point out to tribunal that you know your child

better than anyone and argue the point that your child could regress in the

wrong teaching environment. (Our children are at risk of this). As for

Urani and Conrathe suggesting parents pull out (Helen below), I’ve

heard this said to many parents(honest) before and they ignored this advice and

went on to win at tribunal. Don’t pull out. Go in and fight for what you

believe is right for your child. Tell them how ABA/VBA has helped your child

progress and point out that your child could regress (as all our children can)

in this special school. Have you submitted the report to tribunal which

points out the faults in the eclectic model of teaching that these special

schools operate? Your child is only 4. Still very young. You’re in for a

good chance to win this.

Ps Won a tribunal in 2006,got taken to High Court by LEA lost that and took LEA

back to tribunal and won again.

I think that the LEA have to be seen to be offering a provision that

is 'reasonable ' for your child.... this is in itself v wooly but

as we understood it, it doesn't have to offer the all, singing

dancing model but one that is reasonable for your little one.

We live in cheshire and were heading for tribunal to get ABA instead

of a special school. We had Conrathe, solicitor and

Urani, an Ed Psych. Both v talented and know their stuff. Having

shown Urani the LEA's intended provision, we were advised by

him and Conrathe to pull out at the last minute as the special

school on offer was indeed 'reasonable' (actually Urani said it was

one of the best special schools that he'd ever seen) for our son.

But we had already started ABA by then and it was obvious to the ed

psyche (and us) that wasn't going to be one of those kids who

get thru all the programmes at the rate of knots. He's now 7 and

non verbal..... So what I'm trying to say (but not v well) is that

IMHO alot depends on whether LEA provision is 'reasonable' for your

particular child's needs, and every child is unique and must be

treated as their own special case.

P eta is this different then from funding bands?

is Band 4, apparently band 5 being nigh on imposible to be, in his school there are no band 5's and is one of only 10 children in an SLD school who is band 4 apparently worth 14k to the school.

Hi Sara

The " bands " are for how many hours they get one to one help for. ie

band A is mornings only I think, Band B covers the afternoon as well

and I think band C covers lunchtimes. Even though we haven't got band

C they monitor him at lunchtime. For most of the first year he went

into a separate room for lunch( with other kids with difficulties)

but now he eats with the others and the school covers monitoring him

so he sticks to his diet. He is good and knows he can't have other

kids food because it is bad for his tummy.

The headmistress believes that diet is very important - her own son

had allergies when he was yoounger. She has also borrowed Evidence of

Harm and read it. She is very interested and is telling people about

it - which is good because we are going to the States again for over

4 weeks at Easter!

Hi Vicky

This is the funding bands - we have band B on Charlie's statement and

I think the school get about £6000 a year for that - but I could be

wrong - that figure comes to mind. The school asked for funding at

lunchtime due to diet but the LEA flatly refused - like they would be

bothered if a child regressed! They don't even bother to turn up to

Charlie's yearly reviews which is fab because I am not very good at

hiding my disdain!

Charlie has recently been doing lots of drawings and colouring in -

alot within the lines. This always makes me think of the EP who

assessed Charlie when he was just over 3 at nursery and she said she

observed him colouring in within the lines! He could barely hold a

pencil. These people are such liars - I phoned the EP and told her so-

that I can't bear to be near them. It's like they are not real

people and will stand ther and say yes black is white!

Ranting and premenstrual - not a pretty sight!

I so wish our ed psyche had outright disagreed with us before tribunal, I would never have had her there, she was a complete liability!

At one point she interupted me to argue a point quite forcibly, swear to god if I didn't know better...........

Her name is all over the decision where the panel have pointed out that we were paying her and yet she endorsed the LEA.

If I ever write a book it will be put under fiction absolutely no one would believe any of this actually happened.
