Bonnie,

We have recently gone through like circumstances. My husband was out

of work for 3 years.

We have eventually worked out payments through all our creditors now

but at the time when everyone was calling and bugging us, it was

horrible. We didnt know what to do, We had always had perfect credit

and then the bottom fell out and it seems like once that happens, the

vultures come to feed and they don't care!

We live in OH so our laws are different but I can tell you, they can,

legally take whatever monies you and your family have in your

account. Look into these debt consolidation places. Also if you

decided on bankruptcy, make sure you really reseach which kind to do

cause there are some forms that will leave you with some of your

assets. If you do bankruptcy, it will be in a federal court. States

don't get involved with that. So CA state law won't matter. Here is

Bonnie, They cannot touch your children's SSI and I do not think they can

touch your IHSS because that is also considered your child's money.

I did not check out all your web sites but you mentioned that you could file

a claim for exemption and that would be the first thing that I would do. I

may be wrong but I do not think that they can take your only means of

transportation on this but I am not a lawyer.

Is it your bank that is the garnishee?

Yes, I would call and let whoever it is in charge of this know that this was

an ex-husband's bill of long ago and the only income that you have is that

of your special needs children. I could be wrong but I don't see the sheriff

from out of town taking the only vehicle that you have to transport your

children.

Take a deep breath and do what you always do. Put one foot in front of the

other and start with filing for that exemption. I am so sorry to hear that

you are having yet another problem added to your shoulders.

Thanks Betty for your response. Yes the Bank is listed as the Garnishee, but the paper was sent to me, how do I know if they sent paperwork to the Bank?

Also the name is not the same one the Bank knows me as, so they would have to do some investigating on the SS# to find the account numbers and I wonder if they can release that data and if they have to let me know?

I was on hold for 35 minutes with legal aid and then had to get off the phone since kids were quite out of control and I wanted to get back online.

I still need to know which forms to fill out, may still call the Sheriff since they are the levying officer and who I should form a relationship with. I want to present myself in a calm demeanor though and sound like I know what I am doing.
