Where I live all the parents doing ABA have had to fund it themselves for the first year in order to prove it's effectiveness against standard LEA provision, with their child, same with sonrise, I don't know of any who have had funding from scratch.

I think the legal stand on this for LEA's is that they are only required to provide an "adequate" provision and the onus is on parents to prove the provision is not "adequate".

The people I know also have to prove ABA year on year in order to continue the funding, shame the same isn't done with LEA provision.

Even something small like SLT has to be proven to be inadequate in my LEA, requiring independent assesments and possibly solicitors.

I think there are several things that need to be done:

the major ABA providers perhaps should ask to see the raw data and reanalyse the findings. LEAP, perhaps might do this? The numbers are all quite small and one or two ABA programmes hitting trouble or not being of adequate quality (inexperienced supervisor?) could have skewed the results.

The two measurements were only 9 months apart. An ABA programme runs for several years. There has been no long-term follow-up.

They say the children were all well-matched, but the help they got depended on where they lived: ie if there was a special needs nursery nearby, they went there. We all know that socio-economic conditions of families can vary widely within quite small areas. It's not good enough to say "They all lived in the South-East and so were the same!"

The paper has not been peer-reviewed.

What is the track record of the researchers?

Just some thoughts.

I agree - we are at tribunal next month, would love to read this

report but cannot find any attachment. Sass & Rem couly you email

it to me direct please? I will forward to my ABA consultant and

Yes but surely this is an individual case, and so long as you can prove this is the best provision for your child, the reports would be secondary.

Are you using a solicitor? We have virtually always had to have a solicitor on board, in the past they have caved in immediately, but I am seriously short of funds and trying to appeal my sons statement without this expense and not doing very well.

Yes, we are funding it

and have been funding it for 7 and a half months. We expect to go to tribunal

in September ish so that will be over a year of funding. It’s just that we had

a meeting with the LEA recently and they said that the reason they weren’t going

to fund it was because of this report. A tast of things to come in the

tribunal, I think.

The LEA don't have to make "best provision", merely adequate (see IPSEA website for case law). So you have to show what they're offering is inadequate.

I just posted to UK SpecialNeeds that I had found a stock of the now unavailable title "Taking Action" by and Ruebain. I really recommend it for anything to do with Statements -it's aimed at parents who don't have a lawyer. The 11 remaining copies are available from the RNIB, either on-line or by phone and cost £16.95 each including delivery. A second-hand copy is for sale on Amazon for £39..... obviously, I'm not a businesswoman!

It doesn't deal with Tribunal matters. IPSEA have a publication by Sally Capper called "SENT Ahead" which is some help.

It doesn't warn you about the LEA lying on the day, though, nor teach you how to cross-examine them........

This is all really useful stuff, it all

seems very daunting and impossible to me. there’s no way we can

afford a lawyer but my sister is a lawyer (and doesn’t have a clue about

autism or ABA) and we’re hoping to use her. I’ll look for that book.

Yes, I know, I was just

paying attention to a detail – that’s all. We tried to get out of them some of

the arguments they would be using and this is just one of them. I know that if

we can show ABA works that counts for more than the report.

We can’t afford a solicitor although we

have told them we’ll be getting one. I’ve already written this in another email

but my sister’s a lawyer although not at all specialist in this area and we’ll

be using her.

You can download or order free a hard copy of the SEN Code of Practice 2001 and the SEN Toolkit - essential. (try via the DfES website or teachernet.)

Also the Education Act 1996 is downloadable free (about £38 to buy a paper copy). Some very useful summaries of the law on the IPSEA website, plus useful links.

Your sister should have on-line access to case law via her work with any luck. The standard looseleaf work on education law (Cherie Booth one of the authors) costs £130 per annum.
