Guest guest Posted August 30, 2005 Report Share Posted August 30, 2005 Hi , First off, you must have worked FT in the last 10 - 15 years to qualify. More importantly, you need to NOT be able to do your job because of disability and found " disabled " by the SSA. Not a big battle, alot of paperwork, and before you file, you must have stopped working due to your disability. Your age is also taken into consideration. Medical records are needed along with your application, so your doctor/doctors need to submit info. An initial administrative approval can take as little as 90 days - on the other hand, if a case goes all the way to the Appeals Council or beyond (like to Federal Court) it can take a couple of years. Have a look at the info here and please feel free to email me off list if you like. Oh, one other thing regarding 'qualifications' - you must have a disabiling condition that is expected to last 12 months or more. Remember, bottom line, SSA only cares if you can work or not - and their definition of " disability " is made on a case by case basis. http://www.ssa.gov/disability/ There are some other " rules " coming out soon from SSA on this issue, but first a Congressional Hearing will take place because several attorneys (and myself) have found these " new rules " to be completely discrimatory to claimants. You might also check with your State, to see if they have Disability Benefits, because if it takes, say 6 months for your local SSA office to make a determination, you won't have any $ and in some States, like California, there is State Disability, that begins almost immediately once a person no longer works, and provides $ until SSDI is approved.
