Some of you are stating the issue incorrectly the issue we are addressing is adding a disclosure statement with signature lines to Form 3283 and Form 801 the issue is not if there is steering the workers’ comp division accepts this as reality. The issue is and what we are proposing is a mechanism by which we can as close as humanly possible validate that the employer has fully informed the injured worker of their treatment rights. Our proposal and the issue is adding a paragraph much like and informed consent statement with signature lines to the current Forms 3283 and 801 for example, “This is to acknowledge that my employer has fully informed me of my treatment rights and that I can treat with the health care provider of my choice and that my employer cannot force me to treat with a particular clinic or health care provider.” _____________________/___/___/___ ____________________________/___/__/___Signature (Injured worker) (date) Signature (Employer) (date) So what the profession needs is for you and your injured workers to write Fred Bruyns and support adding the disclosure language and signature lines to the current forms 3283 and 801…… Please, please follow through and do this and remember emails from injured workers first telling how they were never told their treatment rights and/or forced to the local Occ Med Clinic are like GOLD….they carry the most weight!
