It a bully bluff maneauver on the part of the insurance company, based on old data but for some, it is enough to get the patient to comply. This is one I'd encourage a consult with (one of ) the Gatti & Gatti guys. That is, are they strong enough to stand up to their insurance company and ask them for this comment to be placed on paper? Then, I would have them file a complaint with the Insurance Commissioner's office for their review and penalty. To suggest this is fraud is ludicrous. Also, the suggestion of them going to a quality IME, and quality attorney is primary. Let them send your patients to the bogus IME who will indeed with the anticipated prepping letter from the adjuster come to the “no crash, no cash” conclusion a.k.a., no or little vehicle damage the consumer could not have been hurt. Guest guest Posted August 12, 2011 Report Share Posted August 12, 2011 Although I've never heard of a claims adjuster ssaying it's ins fraud, I've heard all the rest multiple times and have not lost a case when clinically justified charting proves otherwise. Also, I ask the patients to politley question the claims person who accuses this by saying, " I'm sorry, what's your medical or mechanical engineering degree? I didn't realize claims examiners were so highly trained! Are you giving me medical or forensic advice about my injuries? Can I please have you call my doctor to speak with them about your medical and/or forensic advice to me? The doctor's name and phone number isXXX." Encourage them to tell the claims person to call you, the doctor. Have the patient be calm and factually state, "All I know is that I hurt after the other car hit my car. My doctor can explain all the medical reasons. Please call them for the medical/forensic discussion you are tyring to have with me." Tell them not to be sarcastic, or rude. Not to raise their voice. Just be polite and factual. They can also ask if the conversation is recorded. Since they always say it 'may be recorded'. Ask for a copy of the recorded conversation. Or say, "do you mind if I record your medical and/or forensic advice to me?" Then be prepared to hit a record button of some sort.
