Military Families Sue Insurance

Company for Widespread Fraud

Veterans file lawsuits for wrongful termination of benefits based on false medical reports

Salem, OR - Lawsuits were filed today on behalf of Military Personnel, honorably discharged veterans and their family members against USAA Insurance Companies for the wrongful denial of medical benefits plaintiffs say were incurred as a result of serious injuries suffered in automobile accidents. Four injured people with present and past military service or family members have filed a class action on behalf of themselves and other USAA insureds throughout Oregon, Washington, and the United States alleging that USAA Insurance Companies have a “practice and pattern” of denying reasonable and necessary medical expenses based upon “junk science” and fraudulent medical reports allegedly written and signed by healthcare providers, which reports are misleading, false, and fraudulent.

J. Gatti of Salem, Oregon, is the lead lawyer for the plaintiffs. The lawsuit alleges that after being paid premiums for medical coverage, USAA implemented a wrongful “cost containment” program utilizing healthcare persons who write medical templates which are filled in by someone other than the signing healthcare reviewer. The reports uniformly limit or terminate expected and necessary medical treatment.

Gatti said, “These folks were obviously hurt in serious accidents and they should be supported and not injured further. At a critical time when servicemen and women have been injured in auto accidents, USAA has implemented a scheme whereby medical benefits are terminated under the guise of medical reports designed to terminate care and save USAA Insurance money when servicemen and women and their families need medical care.”

Margaret Soukup, Clatsop County, Oregon

Plaintiff Margaret Soukup is a resident of Clatsop County, Oregon, and her vehicle was rear-ended with such force it was caused to crash into another vehicle in front of hers on September 15, 2009, causing in excess of $8,000 damage. Soukup is in the armed services working in combat medical training. Soukup’s medical care has been denied payment by USAA in spite of her continued right to benefits and need for treatment.

Brittney Bathurst, Phoenix, Arizona

Brittney Bathurst was 17 when she was a passenger in a vehicle which was hit so hard, a Life Flight helicopter was called to the scene of the collision in addition to police, fire, and other emergency responders. Bathurst’s mother, Bathurst, received recognition for meritorious service while providing logistical support for Special Troops Brigade and did her first Southwest Asia Tour during Desert Storm, and is a veteran of the United States Air Force Reserve who presently lives in Phoenix, Arizona. The reviewer of Brittney Bathurst’s acupuncturist’s care lives in Colorado and the signature stamp of the Colorado acupuncturist is an “electronic” signature stamp which is the same or similar to additional stamps sent to other victims denying care in other accidents in Oregon and other states. Brittney Bathurst presently works as a part-time care giver for an autistic boy in Phoenix, Arizona. Prior to her automobile collision, Brittney enjoyed horseback riding, snow boarding and four wheeling, and all of these activities have been affected as a result of continued pain suffered in her collision.

Amber DeMeritt, n County, Oregon

Amber DeMeritt’s husband remains in the Army after serving in such places as Iraq and Kuwait. DeMeritt’s vehicle was hit with such force on October 10, 2010, in n County, Oregon, that the vehicle spun after being rear-ended and ended in a ditch. DeMeritt’s injuries were denied after DeMeritt received a records reviews allegedly written by a chiropractor whose templates denying care used much of the same language and so- called authoritative sources as templates and reviews received by other military personnel, veterans or family members throughout Oregon and other states.

, Renton, Washington

qualified for USAA Insurance as a teenager, and her collision occurred on February 10, 2009. ’ vehicle was t-boned in an intersection in Renton, Washington. No one disputes liability. Only USAA impugns the nature and extent of ’ injuries. Like all of the insureds, USAA has stated that the medical care and treatment of was deemed unnecessary or unreasonable as a result of an electronically stamped review purportedly written by someone who has never seen for treatment or for an independent medical examination.

Gatti said, “like all of the other plaintiffs, none of the reviewers have ever talked to or consulted with any of the clients’ treating physicians.”

“These fraudulent reviews come in terrible times,” Gatti said. “The victims are not told that as far as USAA is concerned, certain injuries heal within a certain period of time, and treatment will be limited - not based on individual need, but based on pre-fabricated junk designed to save USAA money.” J. Fascinating. Correct me if I'm wrong, but isn't it USAA that has an expensive advertising campaign on TV that is pitched to Veterans? Truth stranger than fiction, once again.

Why am I not surprised. The worst kind of hipocracy. Wave the flag at the same time you're ew-sraying military families (not to mention the rest of us.). Yikes.

I don't watch a lot of television, but during the times that I do, I've noticed a huge surge in TV commercials for auto insurance companies. So while they are denying claims and doing their best to pay as little as possible, they are spending millions on advertisements. Same old same old.
