Guest guest
Date: Thu, 1 Jul 2010 10:49:31 -0400 From: Co-Cure Moderator <rfcolliton@...> Subject: MED: MCS, FMS, CFS/ME: Important legal precedent set in Spain Submitted by Clara Valverde <formacionsalud@...>: A Judge in Spain Grants Full Disability for Chemical Sensitivities for Environmental Accident Barcelona, Spain, July 1, 2010 A judge in Barcelona, Spain, has passed a sentence that recognizes, for the first time, that the full disability of a woman with Fibromyalgia and Multiple Chemical Sensitivities (MCS) was due to an environmental accident that happened in the industrial area of the town of L'Ametlla del Vall=E8s (near Barcelona). The lawyers' firm, Colectivo Ronda, informs today that the woman, I.M., was affected by an environmental accident in which several chemical substances were spillled and mixed together. This exposure provoked in I.M. severe Chronic Fatigue Syndrome/Myalgic Encephelytis, Fibromyalgia and MCS. For this, the judge has granted the woman, retroactively, a lifelong pension of 1,450.95 euros a month. The lawyers of Colectivo Ronda have expressed their satisfaction with the judge's decision and have also announced that they will also sue the mayor of the town of L'Ametlla del Vall=E8s **for having acted irresponsibly with serious consequences to the health of humans and the environment**. The environmental accident occurred in 2008 when the residents of Tramuntana Street in L'Ametlla noticed a strong chemical smell coming from the sewer system, which were attributed to the building of a new firehall in M=E0s F=E0brega, in the industrial complex of Monguit. " For reasons which are hard to understand, the decison was made to dump chemical industrial waste in the sewer system of the subdivision " , say the representatives of Colectivo Ronda. After a few days, I.M. had to go on sick leave with strong migraines, respiratory infections and soon after that she began to have all the symptoms of Fibromyalgia, " which, like in other cases of chemical intoxication, they have left this person totally disabled. " Jaume Cortes, lawyer for Coletivo Ronda and expert in work health prevention and environmental illnesses, instead of presenting the case as a work accident, he presented it as environmental accident. This is the first time that a judge has ruled this type of sentence in Spain according to this lawyers' firm.
