URBANA — A lawsuit over perfume in the workplace will move forward, after

a motion to dismiss the case was denied this week.

Earlier this year, Pamela Core filed a complaint against two of her

co-workers in the Champaign County Department of Job and Family Services after

she argued they intentionally wore a perfume called Japanese Cherry Blossom.

The complaint alleged they wore the fragrance despite knowing it caused

Core to have an allergic reaction.

Champaign County prosecutors filed a motion to dismiss the case, arguing

the complaint draws conclusions that cannot be proved.

But Gerboth, a Springfield attorney representing Core, said the

motion to dismiss was denied this week. The case will be allowed to move

forward, although no new hearing dates have been set.

Prosecutors and an attorney representing the defendants were not available

for comment Thursday afternoon.

Gerboth said that after the incident Core was placed on an involuntary

disability separation, meaning she is no longer being paid by the county. The

case is also being reviewed by the Equal Opportunity Employment Commission.

The complaint alleges that in 2008 Core discovered the perfume caused an

asthmatic reaction. Despite that knowledge, the complaint alleges two of her

co-workers posted comments on Facebook joking about the issue, and later

intentionally approached her while wearing the perfume.

The complaint argues Core was forced to use an inhaler to control her

breathing.
