Guest guest Posted June 3, 2010 Report Share Posted June 3, 2010 As a licensed adjuster myself -- I can tell you that as long as the accident happened in Oregon / all policies have PIP coverage. There is no such thing as Liability policies only -- except in Washington --where PIP is optional. PIP coverage covers any person (driver or passenger) in (or about) the vehicle up to the coverage limits which were increased a couple of years ago from $5000 to $15,000 per person (with varied amounts for the total per vehicle) Also PIP coverage is not determined by any fault. That is payable whether the vehicle the person was in was at fault or not......... If the vehicle they were in was not at fault then they will subrogate back against the liable (at fault) company and that would not go against the drivers record.... and his/her company would be reimbursed any $$ they have paid out on behalf of the PIP coverage (up to the policy limits). If their vehicle was at fault then it is just an amount that would not be reimbursed back to that company and would go against the driver's record/claims but those benefits should be paid. They can deny if there is liability coverage only. Also, is the other driver at fault? If they are you will probably have to wait for payment until the case is closed.
