Without debate in any Committee or on the Floor, special interest language was added at the last minute to the Pension Bill in the House of Representatives. It would force an injured person to pay back their ERISA health plan from any compensation they receive from the wrongdoer that caused their injury. The injured person would be forced to do so even when the cost of future medical care and expenses are more than what they receive in compensation, which is often the case. Severely injured and disabled victims would be left without enough money for their future medical care, expenses that would inevitably be left to taxpayers. Because the Senate did not pass this provision, a conference committee has been convened to determine whether this provision, Section 307, will appear in the conference report.
