Hello Friends: In the aftermath of having attended the conference on People With Diasabilities this past Saturday, it is imperative that I ask a favor of you all (and anyone in your circle of friends; families; organizations etc.). One of the " take aways " from the meeting is that the re-authorization bill in Congress is dangerously close to being passed. The House Version H.R. 1350 is a dangerous, onerous and cynical bill that will do a great many negative things to all in our " community " . A desire for brevity prevents me from going into long detail, but here are some bullet points to consider: H.R. 1350 will: * Remove a parents guarantee to an I.E.P. meeting on behalf of their child each year. This bill will have an " option " of having an I.E.P. every 3 years. Any sane, thinking person can understand that the proposed reason for this " option " , less paperwork for the School Districts " is nothing more than a canard and a subtle chipping away at one of the cornerstone civil rights contained in the original IDEA Bill of 1975. * Removal of the option of having an advocate accompany families to an IEP or Due Process meeting. * 15% of funding that was " guaranteed " to disabled students under the 1975 bill will now go into " pre-referral " services (e.g. the school band; football team; cheerleader uniforms) and the like. * Any due process hearing will now take far longer to be held. We don't have any more time. * FEDERAL MONITORING WILL NO LONGER BE REQUIRED. The states will be left to decide how well they are doing for your child. What can you do? I am enclosing a list of Senators and Congresspeople in this area and how they voted on the " bad " bill H.R. 1350. Also, how you can impact this process. I URGE YOU ALL TO CALL, FAX, WRITE YOUR SENATORS. Both Sen. Corzine and Sen. Lautenberg are supporters of our position. However, please tell them " not to allow changes to the Senate Policy Committee's Version of S 1248, but to leave that version of the bill as is with little or no change as it moves to the Senate floor. Quick Side Bar: Having to sit at the rally on Saturday and listen to Congressman Mike Ferguson (R-NJ 7th District) speak about the war in Iraq, how he " supports " children and families with disabilities( and other completely non-pertinent issues) while glancing at my own copy of the voting list and seeing that he voted " YES " to H.R. 1350 nearly made me sick to my stomach. But, then again, these are politicians. Those NJ Representatives who Voted " YES " to H.R. 1350: * Rob s (D-1st District) * LoBiondo (R-2nd District) * Saxton (R-3rd District) * (R-4th District) * Garrett(R-5th District) ...who at least had the decency to send an aide to " listen " to the comments of the rallyers. * Mike Ferguson (R-7th District) * Bill Pascrell (D-8th District) * Rodney Frelinghuysen (R-11th District) Those who voted against H.R. 1350 and are advocates for our children and their needs: * Pallone (D-6th District) -(sent an eloquent and informed letter) * Rothman (D-9th District)-(brother with Autism) * Payne (D-10th District)-sent very elegant and inspirational letter * Rush Holt (D-12th District) * Menendez (D-13th District) (And don't be afraid to ask the Republican Reps. And Senators why they have such an aversion to helping maintain the civil rights of people with disabilities. Would they, for instance, support a bill that somehow curtailed the hard-won civil rights of African-Americans or women?)? The purposes of this short article are to: * explain the role that Congressional committees play in the legislative process; and * list the members of the two committees in Congress that are working on IDEA reauthorization. I. Committees and the Legislative Process What do committees do? One of the most important phases in the legislative process is the action by committees in the Congress. At present, there are 16 standing committees in the Senate and 19 in the House. Standing committees report on bills or on matters within a certain subject area (for example, special education). The work of the committees, in part, is to broadly study and review issues relating to their defined subject area. The committees do most of the work on proposed legislation. It is the committees that hold hearings where members of the public are given a chance to voice their opinions. Like any workgroup, there are also subcommittees within the full standing committee. These subcommittees often do much of the background work and vote on the bill before passing it on for consideration by the full committee. The Committee that oversees the Individuals with Disabilities Education Act (IDEA) in the Senate is called the Senate Health, Education, Labor, and Pensions (HELP) Committee. In the House of Representatives it is called the Committee on Education and the Workforce. Who decides " who " serves on " what " committee? Membership on the various committees is divided between the two main political parties-the Republicans and the Democrats. A Senator or Representative usually tries to get elected to a committee that has control over an area in which he or she is most qualified and interested. At the present time, the Republicans hold the most seats in Congress, so they are considered the " majority party. " As the majority party, they decide how many members on a committee will be drawn from the " minority party. " Right now, the Democrats are the " minority party.
