According to statistics kept by the court, this is the 20th highest verdict in an auto case since 1988 - a period of 21 years. The case was considered unwinnable by several lawyers due to a second collision that happened one year after the first, and a host of treating doctors who failed to recognize the brain injury. During the two-week trial, DeShaw proved that the rear-end collision had caused immediate damage to the occipital lobe of the brain, resulting in visual and other cognitive deficits confirmed by neuropsychological and visual testing. Farmers highest offer to the client's previous lawyer was $50,000. The highest offer from Farmers after Dr. DeShaw accepted the case was $200,000, made one week before trial. This marks yet another case where Dr. DeShaw has obtained a substantially higher verdict than the insurer's best offer. 's last jury verdict was $105,000, nearly 100 times the average jury verdict in Linn County.
