Hello!

Does anyone know what the recourses on PIP payment is in a

timely manner? I have a patient that was injured in November of 2008 and they

still have not sent me a check yet. They ordered an IME back in Feb. but had scheduling

problems so it finally was done a couple weeks ago. I talked to the adjuster today

and he is telling me it will take another 2 weeks for his medical review department

to get to it!!!

My understanding was that they had to pay at least the bills

from before they asked for an IME. Please correct me if I am wrong, and if I do

have recourses tell me where.

I do not have a MVA oriented office and I find all this very

frustrating.

PIP has 60 days from the time of the bill

to either pay you, or provide you in writing a reason for delay.  If they

indicated within 60 days that they were sending out for an IME, then they can

wait for payment.  If they let you know 61 days later, then they have to pay

for the one visit that is over 60 days.  After they have notified you or your

patient, then they can wait as long as they want.  Legal recourse by the

patient may be in order.
