No, never even heard of it. Of course, I've never sold in NYC.

I think you should just spread it all out on a blanket, and when everybody

else does, just swoop it all up and look innocent, LOLOL.

Sounds to me as if this is a big city thing………………..Peculiar to NYC.

We only need certain permits if we do big shows in Buffalo, i.e. town

Art Festival.

THIRTY DAY STREET FAIR VENDING PERMIT (111)

License Application Checklist

DCA Licensing Center

New York, NY 10004

For more information, call 311.

You need a Thirty Day Street Fair Vending Permit in order to sell

merchandise or offer a service from a booth or stand at an authorized Street

Fair. Thirty Day Street Fair Vending Permits may only be used at Street

Fairs authorized by the Mayor's Community Assistance Unit and only at Street

Fairs at which you have registered with the Fair's sponsoring organization

to vend. A Thirty Day Street Fair Vending Permit cannot be used as a General

Vendor License. Use of a Thirty Day Street Fair Vending Permit other than at

authorized Street Fairs at which you have registered to vend will subject

you to arrest, fine and confiscation of your goods. All authorized Street

Fairs are registered with the Mayor's Community Assistance Unit. A current

list of Street Fairs is available at the DCA Licensing Center between 9:00

a.m. and 5:00 p.m. on Monday, Tuesday, Thursday and Friday, and between 9:00

a.m. and 5:30 p.m. on Wednesday, at the address above. This list is updated

monthly by the

Mayor's Community Assistance Unit and has information on the location, date,

sponsoring organization, sponsor contact and sponsor telephone number for

all authorized Street Fairs.

To sell merchandise or offer a service at a Street Fair, it is your

responsibility to make arrangements directly with the Street Fair's

sponsoring organization.

If you already know how to reach the sponsors of the Street Fair(s) at which

you plan to vend, you do not need to contact the Mayor's Community

Assistance Unit.

After you have made arrangements with the sponsoring organizations of all of

the Street Fairs at which you will participate within a 30-day period, your

next step is to apply for the Department of Consumer Affairs Thirty Day

Street Fair Vending Permit.

You may apply for a Thirty Day Street Fair Vending Permit either in person

or by mail. To request an application, call the Citizen Service Center at

311. To apply in person, bring all of the required materials listed below to

the DCA Licensing Center, hours above.

To apply by mail, send in all of the required materials to:

42 Broadway, 5th Floor

New York, NY 10004

When applying by mail, you must send in all required documents at least

three (3) weeks before the effective date that you list on your application,

along with two (2) color passport photographs (if your photo has not already

been taken at the Licensing Center).

You may apply for more than one Thirty (30) Day Street Fair Vending Permit

at a time.

Thirty (30) Day Street Fair Vending Permit Requirements:

Thirty (30) Day Street Fair Vending Permit Application (download).

Photo ID. Acceptable identification includes:

driver's license or a non-driver's ID issued by a State Department of Motor

Vehicles

passport or an alien card/green card

license or permit issued by a government agency

if applicant is a city, state or federal employee, an employee

identification card, or

certified copy of your birth certificate

Note: If this application will be filed by someone other than the person to

be licensed, that person must submit an original, notarized Affidavit

Granting Authority to Act (download) together with one of the above

acceptable forms of ID.

Submit two (2) color passport-size photographs, or you may come in person

with photo identification to the DCA Licensing Center at 42 Broadway, 5th

floor, to be photographed. Photographs are taken at no cost to you.

Photocopy of your New York State Department of Taxation and Finance

Certificate of Authority (also called a New York State Sales Tax Card).

Enter the number on your Certificate of Authority on the Thirty Day Street

Fair Vending Permit Application form. Applications for a Certificate of

Authority are available at the NYS Department of Taxation and Finance office

at 55 Hanson Place, Brooklyn, NY 11217, (800) 462-8100. Allow four to six

weeks after applying to the NYS Department of Taxation and Finance to

receive your Certificate of Authority.

If your own name is on your Certificate of Authority, nothing further is

needed.

If a trade or Doing Business As (DBA) name appears on your Certificate of

Authority, you must submit the additional documentation:

For Sole Proprietorships, submit a notarized copy of your Business

Certificate. The County Clerk of the borough in which your business is

located must certify this certificate. The address appearing on your

Business Certificate must be identical to the address for which you are

seeking a license. If you are a sole proprietor doing business under your

own name, and not a trade or Doing Business As (DBA) name, you do not need a

Business Certificate.

For Partnerships, submit a notarized copy of your Partnership Certificate.

The County Clerk of the borough in which your business is located must

certify this certificate. The address appearing on your Partnership

Certificate must be identical to the address for which you are seeking a

license.

If your business is a CORPORATION, submit a Certificate of Incorporation or

a filing receipt. If applicable, you must also submit your corporation'-s

Assumed Name Certificate. These must be stamped by the New York State

Secretary of State. For more information, contact the New York State

Secretary of State's Division of Corporations at (518) 473-2492.

If your business is an out-of-state corporation, you must obtain a

Certificate of Doing Business in Good Standing from your home state’s

Secretary of State and file this with an application for Authority to

Conduct Business in New York with the New York State Secretary of State. A

filing receipt from the New York State Secretary of State will be accepted

as proof.

If you are an employee working for an employer and using your employer's

Certificate of Authority/Sales Tax ID number, you must have a notarized

letter authorizing you to do so on your company's letterhead along with a

copy of the Certificate of Authority.

Permit Fee of $10.00 for each month. Must be paid by check or money order,

payable to NYC Department of Consumer Affairs.

LOLOL, I was amazed the first time I went to NYC to see all those vendors on

the street and having it all explained to me. There is a LOT of illegal

selling going on there!!

My dd went there this spring and got a turtle for my ds in Chinatown, which

seems the worst for that kind of thing. I did some research, and found out

that it was way too young to be sold legally. She also asked at CT about a

certain designer purse, and they grabbed her and pulled her behind a curtain to

show her their wares. This kind of thing just doesn't happen in Rochester!

Beth,

You can get jail time in NYC for putting your stuff out like that. They take

your merchandise two times, the next time, it's the clinker for 90 days or more.

Not only would I die of embarrassment, but I would lose my federal job, in which

I have two clearances. LOL!

Hi Marisol,

They started that Consumer Affairs stuff about 8 years ago. When I first

started doing street fairs in 1998 you didn't need a thirty day permit. What

Mayor was in office at that time? You know that the permit is for an actual 30

days and not monthly. I usually get mine for the middle of April and ending

the middle of Oct. which is 6 months. You have to count carefully because

this year the lady taking my application tried to make it 7 months by counting

the actual months from April to Oct. They take your photo and give you an ID

card with a number on it. I like doing the fairs and festival to get my name out

there so when people see my products they will have some sort of trust in

them because they have met me. Well, what can you do? We probably voted yes to

it on one of those little bills they slip through as a numbered proposition.

Someone told me to pay special attention to those bills and read them

thoroughly.

Hi Jeanine,

Same thing here I think maybe Copa Soaps is in Pennsylvania. I have to look

it up again. I was surprised that the festival sponsors allowed us both

there

but as I said I made out pretty good but it was intimidating at first. They

were not even that friendly when I introduced myself. Maybe me and my soaps

should take a little vacation in Pa. one day just for the fun of it of

course.

Hi Marisol,

Yes, I do the festivals all the time. If you go to the Consumers Affairs

Office on Broadway early they are usually fast especially if you have your

paperwork done before hand. You can print out the application online. I

think they

open at 8 or 8:30. Also Clearview productions said they were looking into a

special fee for artisans like use. People who have handcrafted items as

opposed to the ones who buy stuff and resell. I paid my yearly fee with

Clearview

and Mort & Ray because I find they are usually in the upscale neighborhoods

where people are really in the know about handcrafted soap. I am not doing

any

street fairs this year because its too much for me to go into Manhattan but

you

will make money even though there is this company by the name of Copa Soaps

at

everything. Have you heard of them? Talk to you soon?

I just wanted to mention that I know the feeling. Though I dont sell soap but

interested in learning about it to make an educated choice in selection from

local producers, I used to sell alot of my own wares. First I did shareware

for computers before the internet was as popular and people were starving for

affordable programs for DOS machines. Then I went into making floral creations.

some silk and some dried as I was a florist for many years.

When I went to several fairs and set up, I could feel the tension especially

after going to craft sales and doing the farmers markets and running into " the

regulars " I not only felt intimidated but some were outright territorial. One

incident while selling shareware, a guy selling old records didnt like the

crowd I had and started screaming at me that my customers were bumping into his

tables!! He got so crazy everyone ran off and for the rest of the afternoon

hardly nobody came near and when they did he glared at them and started

grumbling about we should move our tables back! (they were right in line with

the

others in my row.)

We tried other fairs, but only broke even (which I found out later we were

lucky ) and then had to remember to pay the tax on time or pay the $50 late

fee... One show I did mostly silk flowers with a friend. The two ladies on

either

side of us told us it wasnt fair that I was selling flowers as the girl

already doing it was disabled and it was her only income! Then she came over

finally

and told us the same story...I told her not to worry as her items were very

well done and seemed to be selling better than ours. And she had made up quite

nice professional display which took her quite a long time to set up and take

down. My girlfriend who was also a florist then said she would never do

another craft show! heh ..I did.. but it was with an organization for fun

raising

or similar.(There was crafts made by several of the members) I did some flower

pots with pens in colorfull pebbles with silk flowers added to the top, so

that when someone borrows your pen they wont walk off with it. They sold very

well, except a few that were made with less care, so I redid them while I was

sitting and waiting for customers. Our booth was one of the lucky ones in that

we made over $100 that day as many of the other ladies told us that they

didnt even make their entry fee. But talking to one lady who knitted baby items.

She did excellent work and took special orders. So people took her business

card. and a few asked her about making something in specific colors. So she

said

her primary goal was just making contacts and letting people know she was out

there.. That is when I decided that I wanted to learn who out there sells

special crafts and learn about them. Obviously you cant do them all! (There are

times Ive tried though!) heh heh.

Im currently still in the research stage because Im going for a knee

replacement in the near future, and finisning some classes I now take, so got a

pretty full plate, and cant to the marketing just yet, but in the mean time

putting

my management skills to work compiling my research and learning the market

and what is selling and popular.

Your a great bunch of gals to share your knowledge and lots and lots of

encouragement. And for that you get a big applaud and hope you keep it going

that

way! People helping each other make it better instead of pure competition.
