There are a number of things that the team has agreed upon, that I have looked at and are not in this past IEP meeting notes. For example, things like: 1) GenEd teacher will provide study guide and/or copy of test to parents 5 days prior to test 2) Communication log will be filled out such and such way (what they did in class, what the HW is, etc.) 3) Homework portion of ComLog initialed by teacher (we had a lot of problems with writing down one thing in her planner, the aide writing something different on the Com Log, and the website for the class saying yet another.... at 7 pm, how do we know which homework is right?) And other things that were discussed, agreed upon and now are not being done. The Resource teacher is useless, and I'm meeting with the principal today to express (again) my concerns for " who is responsible for making things happen? " and plan to mention that although we have been EXTREMELY flexible and understanding in the past, it is putting huge stress on our entire family, and we will no longer be so accomodating, and perhaps will be looking into filing compliance complaints when things are not done. But, before I do that, I want to know more about them, and what sort of documentation is needed.... if it didn't get captured in the meeting notes that we agreed on it, then did it not happen? Guest guest Posted October 18, 2010 Report Share Posted October 18, 2010 Is it not in the IEP as to who is responsible to make sure the IEP is implemented? That's the first thing you have to do. Then make sure that someone signs off on eveything that is suppose to be done (that it has in fact been done)This is why I love the communication notebook because it goes back and forth everyday and it is documentation. Make sure that is in the IEP that you want a notebook sent home telling you that you need to know what went on and was accomplished etc.  If all the stuff you need to happen are not in the IEP call a new meeting and have them put in. Trust me if it is Not in the IEP it ain's gonna happen. I found my school out of compliance on more thatn one isue when Micah was in first grade (remember when they were changing documents on me etc.) but I had documentation through the comm. book and things they had sent home already. When I went to SUPER and told him look I don't want to file a compliance complaint but I will if things don't change. They did and I just got a call actually from Micah's speech teacher about his one to one push in for speech not working. It actually isn't because I wanted them to facilitate communication with his classmates and they are doing the push in during reading when everyone else is doing the SLR reading program and Micah is in Edmark. He doesn't do well with one to one always better in group and so I agreed that we would go ahead and drop this one service as he gets group with 4 other kids the other 4 days. Half hour to me was not worth fighting over. SO she said okay will you call SPED HEAD to let her know so that we can have a meeting because I don't just want to stop then I would be out of compliance. I laughed as I got off the phone cause they are getting a clue!!!! When i called SPED HEAD she asked me what I wanted to do...add another group session or what. Now THAT is a turnaround. But you have to be very pleasant but get it ALL in writring or you have nothing. Once it is in writing they know they must comply., Whenever you speak to a teacher principal or whoever concerning your daughter keep a log book and write it on the calendar. EX: I spoke with Principal big shot on the 12th of Dec concerning their not being in compliance about doing such and such. Princiapl big shot said " whatever " . This is documentation that something is going on and if you end up in due process you have a running log book of whatr has been happening. You will be much more credible with this. Who the heck would keep all the info for fun. Besides if more than one person is involved and they are lying it gets better because they all tell a different story lol! You have supplied the questions from the log and the answers given at the time you documented but their will be a whole lot of differnt answers from everyone else. When they don't add up your credibility quotion goes up. Record keeping and documetation is vital. I also tape phone conv. here which is legal as long as one party knows it is being taped (me) find out about this in your state as the laws are all different. I've been going through the IEP, IEP notes, emails and our Communication Log (which is similar to Micah's) and think I have my plan for this afternoon. The special factors page does say " study guide and tests in advance " but they did not put the " 5 days " in there, although I have emails on the topic.... bet they'll balk at putting a number in. I made a lovely calendar that showed when I requested meetings (and when they happened, 4 1/2 weeks later), complete with email documentation, and also the number of days her aide has been absent (12/36 days, but who's counting!)... not to complain about the aide, she's great with when she's there, but when she's not, things are not followed, and we've met more than once to talk about the sub folder and how to make it bulletproof so that anyone who shows up to work with will do everything right (they've not had time in the past 3 1/2 weeks since our last meeting to update the folder, and the aide has been absent 9 days since then.. you'd think they'd make the time to update!) My calendar also shows when social studies tests were, and when (if I did) receive the required study guide/test. I am a visual learner, so I'm hoping that my charts and graphs might help them out too! I also made an org chart for responsibilities, and with the principal, I'm going to ask her to " help " me draw all the arrows as to who is responsible for what, and when things don't get done as promised, who is responsible for what. The RSP passes the buck to the aide so much, it's insane. So, I want to get some of those arrows drawn to her! Also, I am going to request that I be permitted to be a sub aide for (paid, and only if I choose to pick up the sub contract that day, but I will be given first chance), it will save me huge amounts of frustration and stress if I were just there at school writing down the homework, making sure her PE clothes get home, etc.... takes tons more time to figure this out at 5 pm when no one answers the phones or emails! We were both completely on the same page that this meeting was to first and foremost, define who exactly was responsible for all of these bigger issues, and then work towards the irritating stuff. Her plan is to talk to both the program specialist (district administrator) and the RSP (case manager) and get in writing who exactly will implement what. She will get back to me by the end of the week and at that point we will make our next move, if necessary. I did not even mention compliance complaint because she was working so hard to capture all our concerns, and develop a plan going forward. She looked at the communication logs (partially filled out, no HW listed, etc.) and sighed... " it's not rocket science to fill this out properly " was her reaction, but was happy that I am planning to make a " sample " to put in the sub folder. Had things not gone well today, or if we don't get the reply we are looking for on Friday, I've got my data together and will be ready to say " here's our next step. " The principal is, and has always been, very supportive of us, so I am willing to give her some time think. In this case, we don't really care who is given responsibility for x, y and z, just that someone is (either the GenEd teacher, RSP, aide, etc.) so that when things don't happen, we can immediately document and act. A lot of this stuff (like providing study guide 2 class session before a test, which with our rotating block is essentially 4+days) is written in the IEP on the " Special Factors " page, so there is no one listed as responsible like the IEP goals.
