UGH - this awful - the it's the victom's fault " mentality

Time to take a PRO-ACTIVE stance with the school that they are FAILING TO

KEEP HER SAFE. It is not HER skills which are lacking...

who runs the afterschool program? Is it on the school grounds?

It's a violation of her rights under ADA and Section 504 to deny her the

right to attend.

PLUS - THEY have the duty to keep her safe, not you. She is THEIR

responsibility. It's THEIR negligence which is at issue.

If there was a rabid dog running around campus biting kids, what would they

do?

WHO is biting her? THAT is the child who needs restraining... not your

daughter.

Wow, I think they are being pretty stupid - THEY didn't supervise this child

or the child that bit her not once but 7 times. I didn't say this before,

but I'd call CPS. They need a wrap around for the adult that is

responsible, not put that responsibility on you and Vicki. They should be

ashamed!

but do I report the school or the private after care program..... would they

end up investigating us too?? not that this could have happened here but

with staggered shifts trying to find a good time with everyone is not always

easy

It is a privately owned daycare that operates on school grounds at most if not

all of the elementary schools in the norristown pa school district..... and

since no adult admits seeing it happen and none of the children who range in age

from kindy to 4th and 5th graders have been able to identify any time when they

saw victoria getting bit.... we can not even be sure whether it happened in the

before school program or during school..... but for that many bites to have

happened this child must of gotten victoria alone... and they admitted that a

suspected child and victoria were taken to the bathroom together tuesday

morning.... they say an adult was there the whole time but who knows if she was

distracted by something else or turned her head for a bit.....

we dropped medical assistance when we were getting flack about not having the

assistance doc being primary even though vickie and the whole family had been

going to this other doc for years before she was born and who just happened not

to take the assistance plan... our current doc does so I have just applied to

get the assistance again... but they can not even begin the intake process until

we get that insurance..

I have already called my advocate from MARC.... waiting on his call back

Vickie has been brought to our family doc and she documented all the bites and

is as appalled as I am

I told the director of the program that I felt that we were getting punished

since vickie can not identify her assailent and that if she was more verbal this

would be dealt with by removing the other child not victoria....

we had a meeting at school today which was attended by both my husband and I,

the school principal, school guidance counselor, the director of the extended

school day program and one of their teachers.... they are all concerned about

victoria's safety and they believe they have done everything adequately to

provide for her safety but they can not without an one on one aide of which the

school district said they were not responsible to provide... that was when they

gave me the infor for the wrap around agencies....

hubby and I are just somewhat stressed right now.... this was allowing my hubby

to sleep more consistently before his overnight job and allowed me to leave for

my job 1 to 2 hours earlier in the day which made it so I could get home by 4 or

so most nights instead of closer to 5:30 or 6... it also allowed my son more

time to do after school activites or be with his friends which as a high school

freshman is important...... and now all of that for at least the next couple of

weeks or so is out the window

The private after care program. I'd also call daycare licensing (who btw,

could be a great supporter regarding advocating to keep Vicky safe vs wrap

around aide). Daycare licensing should also be able to tell you if they

have received other complaints- where CPS can't.

The private after care program. I'd also call daycare licensing (who btw,

I am not sure what state you reside in but if this was happening in my home

(I run daycare in my home) or at a center I would certainly hope someone

would call licensing and file a complaint. Some children do bite but

was bitten way to many times and there is obviously a lack of

supervision. If you need help locating the licensing number I will be glad

to help - just need to where you are exactly and I will find the info for

you.

To qualify for wrap, she needs an axis I diagnosis. DS does not

automatically her. I believe safety is an issue which they will consider BUT

she is not the one not being safe, it's the other kid-so maybe THAT OTHER

kid is the one who needs wrap.

Nic qualifies because of his ADHD

the program

I don't know your exact situation, or Vicki's age, but I know a lot of our

kids have one on one aides...why is the school dist saying she can't ?

yeah I am starting to feel that way also ... but the question is... what type of

lawyer should I be looking for??.... special ed?? education in general??

personal injury??....

should I bring her to the local police station and get these documented there??

the pictures I took were too close and the flash washed everything out and you

can't even tell there was a child there

I don't know how it works in PA, but in Virginia, if we were to get in home

services (which could also serve in the community), then he would

have to have an Axis 1 diagnosis (which he does). Down syndrome falls on

axis III while MR is on Axis II. We are limited to six months of services

only - urgh!

wow, Nic's had wrap for almost 2 years now.

Yes, Nic's Axis I is the ADHD Nic actually has 5 Axis diagnosis DS is #2

or 3. lol can't remember them all.

The TSS (aide) will go outside the home. Ours wasn't allowed by the

insurance co to go with Nic to school because he already had an aide there

(even though she was not a trained side, just a babysitter)
