Does this also apply to PIP? My assistant and I were debating this just now. Also, does this mean we can charge the patient for the amount our friends at the insurance companies have discounted? Yes, if the Workers compensation case is denied you can charge your usual and customary fees. Don’t lose sight of the fact that many Workers will fight the denial and secure a W/C attorney. If it is dicey and has a chance of being denied but then bouncing around in appeals, you may have to sit on the bill for awhile. Sometimes the patient makes a geographic move leaving you to seek accessories to go with the bag you are left holding. I had a terrible case where Starbucks accepted for awhile then denied more care for a simple slip and fall WC claim. The patient came to me referred by her MD in Eugene for 2 rounds of 12 visits. Great results because I am an excellent adjuster and I made her start lifting weights. Although the MD was paid for all re-exams, I was forced to sit in the back of the bus, was called names, and my payments were denied. It gets better. She went for a special hearing and the insurer was ordered to send them ALL OUTSTANDING BILLS for evaluation. (All this without my knowledge as we kept asking and waiting for months for results.) They sent about half of the bills to the WC referee. The hearings referee forced them to pay. They paid me my fees for the bills sent and gave the patient a wad of money for her trouble. When I asked where the rest of the money was, they said it was all doled out properly. When I sent them copies of the EOB’s showing the steenking comp. carrier had been billed and had denied payment for twice the number of dates of service that they reported thus proving that they had intentionally failed to forward the rest to the WC carrier, the WC referee said, Gosh, that’s too bad. I said, It’s fraud. They said, yes, it’s terrible. I said, it’s illegal. They said, sure, quit whining, you made tons of money off this claim, be grateful, is there anything else we can help you with today. We called the insurance company and were told that part of the settlement was to pay for the medical bills. We tried for months to get paid by the patient. I think we finally suggested that maybe a collection agency would have to be involved. Soon after that, the patient walked into the office with a big stack of $1 bills and said "Here's your effin' money!" and threw it in my receptionists face!
