We appreciate your leadership and direction. Please see the attached proposed amendments submitted on behalf of the Oregon Physical Therapy Association. We have worked on this language in response to Thursday night's hearing and also in response to Dr. Vern Saboe’s proposed -3 amendments. Committee staff forwarded the proposed -3 amendments that were submitted by Dr. Saboe and we have incorporated this language into our proposed amendments as attached. We have also included definitions for the terms being used since a lack of definitions and differentiation between terms appeared to be at the heart of some of the confusion on Thursday. Our amendment proposes to insert the new language into ORS 688.010, the existing statute that defines the practice of physical therapy. The new language specifies that manipulation and mobilization are within the scope of practice of physical therapy (under subsection (6), subparagraph ©). Again this is to avoid future confusion and to clarify that this is within the current scope of practice of practice of physical therapy as it has been for many years. We have then provided a definition of “physical therapy manipulation and physical therapy mobilization” for clarification purposes (subsection (7)) and to lend some definition/description of this procedure. We feel it is critical in resolving this issue to have some definition of what this procedure means in the context of its utilization by physical therapists. This definition comes from the American Physical Therapy Association’s Guide to Physical Therapist Practice. Subsection 8 inserts the language that has been proposed in Vern Saboe’s -3 amendments to clarify that physical therapy does not include chiropractic spinal adjusting or chiropractic spinal manipulation. We then added further language in a new subsection (9) which states that nothing in the chiropractic or the physical therapist statute shall be construed to prohibit a licensed physical therapist from the use of “physical therapy manipulation or physical therapy mobilization” as defined in subsection (7) of the proposed amendment. We appreciation your willingness to assist us in resolving this issue and would like to make sure that chiropractors are able to practice within their scope, training and education; while also making sure that physical therapists are able to do the same. We feel there is a place for both professions within the health care field. We believe that this language provides an opportunity to provide clarification, avoid future confusion and address the concerns of both sides.
