Guest guest Posted December 28, 2006 Report Share Posted December 28, 2006 Dear Colleagues, " Getting involved can make a difference " I'm sending you the latest correspondence between myself and the policy analyst for the Workers' Comp Division relative to the issue of Oregon injured workers being told they must go to a particular medical provider by their employers and even sometimes by the insurance carrier. Please look at the attached new " Form 3283 " which must be given to injured workers by the employers when they report and injury. You will notice under the left sided fourth bullet the concept I suggested to the Division which states: " Your employer cannot choose your health care provider for you. " This is a huge statement to employers who are currently steering injured workers to the " company doctor, " or the " Urgent Care Clinic, " or the local " Occupational Medical Center. " Or even telling the injured worker when they ask that " they can't see a chiropractor, they are not authorized to see a chiropractic " etc., etc. This is a very key development within the bowels of the Workers' Comp Division. ODOC and the CAO are working together and working very hard to gain an expansion of chiropractic services within Oregon's Workers' Comp and we remain hopeful. However any expansion will mean very little if the patients are continually being told by their employers they must go to this or that medical provider or even that they cannot see a DC! Just wanted you to know that we are shaking some folks trees and the fruits of our labor are starting to land on the ground !!! Vern SAboe Re: DRAFT Notice to accompany Form 801 Dr. Saboe, Thank you for contacting me about this. Staff are working on a revised " What happens If I'm hurt on the job? " now, and we will revisit the Notice (Form 3283) that accompanies Form 801, if needed. However, because the 3283 does not give any time limits, and it does not define attending physician, I think it will still be true when the new law is effective. Its emphasis is the worker's right to choose a health care provider, and HB 2756 did not limit that. We would welcome your attendance at any or all of the advisory committee meetings. I have attached our rulemaking calendar that provides information about these meetings. Because laws are effective the first of the year (or earlier), all of our rulemaking must be completed prior to that. On our current time line, notice of proposed rulemaking (summary of changes, Web site look-up information, how to get hard copies, etc.) will be mailed before the end of August. WCD staff are also preparing documents that providers (DCs, NDs, PAs, & Podiatrists) will review before acting as attending physicians after the first of the year. We will notify these providers using lists from the licensing boards. I cannot say exactly when we will mail the documents, but the entire process, from mailing to review and providers' responses - must be completed by 1/1/2008. So here's to the end of the inappropriate steering of Oregon Injured Workers to the local Occ Med Clinic, the Urgent Care Clinic, or the " company (hack) doctor... To the continued good fight cheers, Vern Saboe Re: DRAFT Notice to accompany Form 801 Dr. Saboe, We sent a notice to roughly 90,000 employers, medical providers, and insurers, etc., in March of this year, along with the " Guide for Workers Recently Hurt on the Job, " that was developed through your efforts and input from other committee members. Here is the link to that publication: http://www.cbs.state.or.us/external/wcd/communications/industry_notices/choo se_prov.pdf Because the mailing prompted a number of calls from employers (who began to question their own practices), we think it did serve to educate many system participants about worker's rights to choose providers. We are still drafting changes to the larger brochure " What happens if I'm hurt on the job?, " to reflect recent law changes, and we will send this to the advisory committee before too long for your input. One other change that we have yet to implement is a telephone message system that callers could use to get prerecorded messages on three primary questions: 1) How do I file a claim; 2) How can I get treated (and who by); and 3) How can I get paid for time lost from work. We have the system more or less designed, but we have not had staff available to do the phone programming (due to illness), so that has been delayed.
