At THAT time, the best advise I could find said....if you are being asked EXPERT WITNESS questions, there is an EXPERT WITNESS fee schedule... I had a little talk with one of the attorneys that was making quite a living off WC cases....and was amazed to learn from 'a previous associate' some had come to believe DCs were a soft touch....most of the time if you are NOT testifying as an expert witness, there is another way to get the information the attorney wants into the court record.... The strategy that proved effective those long years ago, was to have a little talk with the appropriate council....and clarify whether he was anticipating meaningful opinions from a prepared and willing EXPERT, or something less.....sometimes these 'must appear' situations resolved into 'records only' etc.... IMHO, if they are compelling you to appear as a professional expert witness, they have to compensate for your time away from your business....I had times when they paid very well, " portal to portal " , PLUS my lunch because he didn't manage to get me on when he had scheduled....we had covered that, my time waiting in the hall was the same fee rate whether I was on the stand or not....time away from your practice was what they were buying....and that cost plenty....
