PIP, the comp fee schedule, and the memo.

Listmates:

Attorneys are starting to run into resistance from the PIP carriers re

payment of services. I recall there was some back and forth about the

Insurance Division's memo and what it would say. What was the final result?

And is there a link to it on the DCBS website? Thanks.

Chris: The discussion was relative to the division beginning to wonder if

the 12 visit 30 days treatment restriction applied.... " was that the

legislative intent of HB 3668. " I was able to get the Committee members to

instruct Mortar in the Ins. Div that this was not the intent that

invoking the W/C fee schedule was and that restriction of benefits was not

the legislative intent.

With that said PIP is now locked into the W/C fee schedule and as such the

carriers can no longer use their " in house usual and customary " fee

structure they must follow the W/C fee schedule.
