If you choose " reply all " the person who sent it to you gets duplicate messages like you are with this one. Your efforts are appreciated. However, dear colleagues the HB 3668 situation and the possibility of our being restricted to 12 visits and/or 30 days is handled...but we must stay diligent. Stay tuned..... Guest guest Posted February 6, 2004 Report Share Posted February 6, 2004 You might look at the different standards of care inherent in the workers comp world and the PI world. In Washington, the worker's comp standards are " fixed and stable " for closing a claim, essentially meaning that the worker can return to previous occupation or vocational rehabilitation. If there are “residuals”, the workers’ comp carrier will pay a settlement according to one of 5 categories. Most chiro cases will fall into Categories 1 or 2, meaning nothing and next to nothing. This is essentially a compromise between the needs of the employer to have a labor pool, and the needs of the employee to have some means of obtaining assistance should they be accidentally injured without suing the employer. The PI standards are pre-injury status, or MMI. This is a tort, where one party negligently injures another. I can’t imagine the courts would essentially say, “Yes, you were injured due to another individual’s negligence. Tough.
