Hey all,

Just had a patient DME'd and she thinks there was a two way mirror and that she was being watched or filmed. Is that legal???? Does a client have to be informed that they are being watched. I know in psyche they used not to because they sign away their rights (practically) when inpatient. What about at a DME.

There is a very specific Oregon law that disallows such a practice. Interestingly it was an Oregon legislator who got caught doing something (can't recall what) wrong or inappropriate on hidden film that passed this legislation. There is a real question if this Oregon law would hold up to a constitutional challenge but no one has gone there.

How I know this? A certain national television company has for nearly a year been going into these examinations with hidden cameras and it is due to air shortly. About a year and a half ago when I asked the producer if the TV company was going to do this in Oregon the producer told me no because it's against Oregon law.

It is my hope this production is going to be as good as anticipated as per documenting the current nationwide problem with IMEs/DMEs.

That was the long answer to your question which is, it's doubtful she was being filmed, but if so, it was indeed unlawful.

The piece is still in editing and the current reporter involved is going to give me a early heads up of the air date and time as she knows I wish to notify every Oregon legislator....should be fun!

Talk to the lawyer representing the patient. It could possibly be argued that the patient had more than one exam.
