Hi, glad to hear you are doing better, i applied for SSD and it took me over 3 years to finally get it, well i havent got it yet, i had to go thru a hearing in front of a judge just a few weeks ago . I also lost my job and alot of friends so now i stay pretty much to myself. Also lost everything i had,, got evicted from my apartment and had to move in with my brother & sister in law, for the first 2 years i had to live in their garage, try that living in Phoenix in the summer time lol. damn hot. But now im fine and doing alittle better, planning on moving to cooler climate and start my life all over whatever is left of it. I thank God everyday for giving me another chance in life and tresure every moment of it. I wish you all the best and keep smileing everyday. , I recently applied for SSD. I have an appointment with a Dr. in July to examine me for my SSD claim. I've heard it can take a long time to get approval. I was also told not to use a lawyer because they get 1/3 of the SSD. Have you got any pointers for me? Thanx. Hi Joe, No that is not correct on what a lawyer will get if you file for SSD. I am currently applying myself, my lawyer will get a portion of my back pay, but I think it can only total $5,000? (I am not sure if that is the correct amount, but it is close). There is a cap of what they can get and if you loose, they get nothing...personally I think it is worth having a lawyer as it seems the only way to win with SSD. I have been in the process for almost a year now, but I really have nothing to loose, and hopefully everything to gain. I have had 2 back surgeries and continue to have problems. I am also filing for my son who has an ICD and has had 3 heart surgeries...a lot of paperwork and time, but hopefully worth it? Hi Joe, Depending on you problem i would not hesitate hiring a lawyer. I didnt get a lawyer until after being denied 2 times and i finally was so upset and felt i couldnt deal with the assholes at SS anylonger i hired a lawyer to take carer of it. If you do decide to go this route i would suggest that you hire one that only deals with SS cases. Where are you located ? The reason i say to hire a lawyer is that one they know in the in's and out's of the system. Have you been denied yet ? Are you going to one of the SS doctors? Also as far as what the lawyer gets it is either 25% or $5300 of your back pay and thats it. Thats the law i think. If you have any questions you can call a SS office and they will tell you. Be carefull what you tell them. They are sneaky. They will try to find anything to deny you. If you can tell me why you are applying for SSD that would help. I'll tell you a funny

after i got denied the second time i decided to go to the SS office and look over my file, had to make an appointment to do this, anyway when i went there they took me back to a desk and while i was sitting there looking over my file this lady comes over and sits directly accross from me, now here it comes, she asked if i had any questions , said no i just could not understand why i had been denied well she starts writing something on a piece of paper and slides it to me, it was a phone numer, hell i thought she was giving me her number, couldnt getr that lucky lol. It turned out to be the number of a lawyer , well come to find out her husband works for that lawyer lolo, talk about a conflict of interest lol, anyway i ended up using that lawyer and won. It seems so strange that they charge so much i had never ment him until the day of my hearing and he gets that much, in the wrong business i guess

lol. Now it's just the waiting game until i start getting any money comming in, the lawyer said it might take 2 months before i see a check. Joe,

I went with Binder and Binder here in New Jersey. They have a website, which is www.binderandbinder.com. Their fee is 25% of the past due benefits to the claimant or maximum amount which is $5,000. That is it. I never had to go to a court room or a lawyers office. I did however fill out a lot of forms and had a case worker to talk to. The case worker was great. All my doctors had to send them all of my records and I went to some of their doctors. (Social Security) It took me about 8 months to be approved. I see from reading some of the posts that I was lucky. I don't know why it takes some people so long, it's a shame. Binder and Binder are lawyers for this type of claim. They really helped me.

Hi Again Joe

Just wanted to make a correction from my last post. is right...the maximum is $5,300. I made a mistake and put $5,000. Like said , don't give up and get lawyers that specialize in this. I did all of this on my own, no one helped me. The internet has been a wonderful source for a lot of help I get and information.
