Interesting side note apparently SAIF officials were caught red handed shredding documents by either a state or federal official investigating them, and told to immediately stop all such activity or the lot of them were going to jail! SAIF's credibility is currently in the toilet and considering the mis-information perpetuated against our profession by SAIF officials they seem ripe for a class action suit by us! It would be very easy now, in retrospect, to go back and prove that SAIF wasn't losing a "million dollars a day," that most (if not all) of the charges against Chiropractors were bogus, and that SAIF and certain "other" persons (who rammed this through) PROFITED as a direct result of limiting patient access to Chiropractic. The key thing about 1197 is that only "CHIROPRACTIC" was limited. Spinal adjustments, massage, therapy, exercise, rehabilitation (all the services chiropractors were providing) were not restricted. Patients could go to "other providers" for these services with NO LIMITATION! So, SAIF saved "some sum of money" at the expense of CHIROPRACTIC. That is the very definition of racketeering! They profited through "fraud" (i.e., providing false financial information to the legislature). That is illegal for ANYONE (state, federal..it doesn't matter). There's also a question of restriction of trade, and the possible creation of a monopoly situation (i.e., only "medical" personel could provide certain services beyond 30 days). If THEY can provide "spinal manipulation" beyond 30 days, why can't we? We should contact every Chiropractor in the State (and those who left the state) and fund a class action law suite against SAIF and the State of Oregon (I know Vern's cringing on this one...). But, it was Oregon's governor, attorney general, and legislature that passed this law. They are the ones who should have acted responsibly and legally to protect the citizens of Oregon. They didn't. One caveat , about two years ago I called an attorney in Texas who specializes in this sort of thing. Apparently as I recall the statute of limitations would have run out on going after the state...not sure if this would apply to SAIF...just a F.Y.I. So are you game to start researching this??
