Dear Colleagues I would like your feedback as per the following legislation, how would you like to see the CAO and its lobbyist respond to the following proposed legislation?

House Bill 3120

Eliminates the duty of physical therapists to refer patients to physicans (including DCs) after 30 days fro initial physical therapy treatment. My comment is that they do not have the same differential diagnostic accumen that you possess that the one ingredient in your training that allows you the distinction of " doctor " of chiropractic rather than " chiropractic therapist " is your superior training in lab, X-ray, physical, and subsequent differential diagnosis. House Bill 3218

Increases PIP coverage from a max. of $10,000 to $25,000. This bill also increases liability coverage from a policy max for bodily injury or death for one person which was previously $25,000 this bill will increase this to $50,000. HB-3218 also increases the minimum required payment for $50,000 to $100,000 for bodily injury or death of two or more persons in any one accident, and increases from $10,000 to $25,000 the payment for injury or destruction of property of others in any one accident.

Since many is the times patients whom have suffered a more serious injury e.g., disc herniation, which require surgery or the intradiscal thermal treatment, discograms, MRIs, etc., the $10,000 PIP coverage can go fast, and for the similar reason for the other coverages this makes sense. House Bill 3442

Requires committees, groups, teams and similar organizations that advise Health Division about immunizations to have specific membership. Requires practitioners (names chiropractors) and programs that provide vaccinations to children to give information about potential risks of vaccines to parents of child. Senate Bill 450

Adds a philosophical exemption in addition to the current medical and religious exemptions for Oregon's current compulsory vaccinations. Senator Kate Brown introduced this one and I say Yes to SB-450 what do you guys think??

House Bill 3143

Modifies the definition of physical therapy. Seems ok, it states " physical therapy does not include chiropractic as defined in ORS 684.010 " what do you think, go to http://www.leg.state.or.us/01reg/measures/hb3100.dir/hb3143.intro.html

Senate Bill 885

Would set up a rather arduous " Pain Management Commission " in the Department of Human Services and would require us and all other health care providers to go through some form of " pain management education " as a requiremen for license renewal, NOT! Thats my take on current proposed legislation, the good news is that there is apparently no attempt at coping the horrible Colorado PPO Option PIP law, thank goodness and I/we need to keep a watchful eye however. We must never become apathetic as in the " fat-80's " leading up to 1990 and SB-1197!

We all need to help keep a look out you can search for any such negative legislation by going to www.leg.state.or.us then go down to bills and laws (purple box) and then half way down the page to " current 2001 " to search the current bills which have been introduced. You will see the place were you can type in key search words like, oh let me think, oh ya, PIP!, or chiropractic, or personal injury protection etc. We all need to be doing this.

WHAT DIFFERENCE DOES IT MAKE WHAT THE MAX IS? I HAD A 5 YEAR $25,000 MAX ON PIP. I WAS EXAMINED BY VERNE. HE CAN TELL YOU I STILL HAD PROBLEMS AS A RESULT OF THE MVA I WAS IN. BUT ALLSTATE HIRED ONE OF OUR OWN WHO CUT MY PIP BECAUSE I WAS TREATED FOR MORE THAN THREE MONTHS. AS LONG AS WE HAVE HIRED GUNS IN OUR OWN PROFESSION WHO SAY WHAT THEIR MASTERS WANT, AND DO NOT CARE WHAT THE SCIENTIFIC PAPERS SAY, A PIP MAX MEANS NOTHING!

I am not in favor of opposing PT bills; I think that health care providers should stick together for the most part. If the DCs get a reputation for helping out other professions (including medicine) when they need a hand, perhaps we can start to see some reciprocation.

Good point, which is why I wanted us to form a " Health Care Coalition " such as what they have in Colorado, everyone that has a stake a pain management and whom stand to lose with certain legislation we could come together just prior, during, and after the session to determine what legislation we wish to support, fight and initiate. You were to be my key guy " big bags. "

I agree with your positions on these bills, including raising minimum PIP coverage. It's not uncommon to run through the first $10K of coverage in the first couple of days of a bad accident.

House Bill 3143 could be an important first step to defining the adjustment (aka low amplitude high velocity thrusts) as an exclusive chiropractic or osteopathic procedure.

I second 's position on this. We are too small, and too

fragmented to achieve much of anything by ourselves. Collaboration

with other groups of providers is key to our future success in

legislative matters. We will have more and more in common with them

over time as they deal with the same economic squeeze from 3rd party

payers that we are dealing with. " Healthcare workers of the

world unite! You have nothing to lose but your chains. "
