I guess it could be different for each state. What I did, because I wasn't sure, is just not do anything for first grade. They actually called me to tell me I had to submit one every year. They did not ask me for it at registration, so unless they say something, i'm obviously not bringing it up. I think I will have a new on at the ready, tho in case they ask. I suspect most schools in most states have no clue what the law is and might assume you need to send it in each year. I only send it if a health form is asked for (and last year I ignored both the public and private schools my kids go to, and didn't send in the required health forms--and no one asked!).
