Guest guest
I wish I had better advice than this but: at least call your lawyer (first thing Monday morning!!) - from the sound of your post you have one - call him. See if he'll give you some kind of advice over the phone as to what your basic rights are and ask if he thinks he needs to be there with you when they come on Tuesday. So many things get so incredibly messed up b/c people don't understand their rights and/or they wait till late in the game to call a lawyer. I understand the money thing - that's a legitimate concern...and from the sounds of things this isn't going too badly - but at least call your lawyer and go from there. Legal stuff gets hairy and DCS can be a BEAR to deal with. TRY (I know it's hard) to stay calm and cool - call the lawyer and go from there. > > Hey All! > > I need some help here. Long story short, I was a whistle-blower at work and ticked some people off. One of them (I'm quite sure I know who it is) called DCS .... > Also, they're supposed to be coming to my house on Tuesday. Should I have my lawyer here? I really can't afford him, but wonder if I should do it anyway? > > What if I refuse to sign the paperwork/forms that they bring? > > What do you think will be done after their visit here? Guest guest
I don't know what to tell you in terms of having your attorney there or not. You at least might want to consult your attorney. I will tell you that most DCS are so consumed with real cases of abuse and neglect that they don't have the time and inclination to pursue parents who aren't neglecting or abusing their kids. > > Hey All! > > I need some help here. Long story short, I was a whistle-blower at work and ticked some people off. One of them (I'm quite sure I know who it is) called DCS the other day and reported me and my ex as neglecting my daughter (that she was dirty, unbathed and not well fed) and also said that we both use Marijuana. All of the allegations are totally untrue. > > Nonetheless, they still showed up at his house the other day. A DCS worker, a Sheriff's Dept. investigator and a social worker (he believes she is the one who would take a child away if there was proof of neglect). He let them in, they looked around. He signed a bunch of paperwork...says he received copies but he's not sure if he got copies of all that he signed. He said that most of them are basic forms stating what DCS does and basically he signed acknowledging that he understood and he also signed a form saying that DCS can get all of her medical records. > > I haven't been on in a while, but my daughter is totally unvaccinated. And this is what terrifies me the most!!! Will they use this as a reason for neglect and try to take her away or try to force vaccinations? > > They tried to find me on Friday but I was unreachable (and had my daughter with me). The investigator talked to me on the phone on Friday night and told me that she basically thinks already that the call was unfounded but they still need to investigate and " see the child " before they can close it. > > Ok...with him already having signed the forms to get her medical records, do you think this is going to lead to a problem? Again, the allegations are totally unfounded, and I understand that they still need to investigate any call they get. But this is one agency I've been terrified of all along and it's like the nightmares are coming true. Can anyone offer advice/input? I would greatly appreciate it. > > Thanks so much! >
Guest guest
If you don’t have any written exemption form yet, get one. It is your legal right not to vax but the form gives you in writing proof. I would not let them see your child alone and since the ex already let them in, don’t know about that but since you live separately, they can’t just enter w/o your permission and they can’t see your daughter alone w/o your permission. Don’t give it and call your lawyer. This is one of those times that you can’t afford NOT to have some sound legal advice. The DHR in our state has made life a living hell for some friends of ours including false reports and false statements. If their daughter ever got her head on straight, she could sue them and never work a day in her life. Guest guest
You absolutely positively need a lawyer right now! Put it on the cc if you have too. > > > > Hey All! > > > > I need some help here. Long story short, I was a whistle-blower at work and ticked some people off. Guest guest
Having worked with families anticipating CPS visits, there is nearly always a darned if you do OR don't regarding what to sign, where to have your child viewed, by whom, etc. Ideally the person could meet you in the attorney's office AND the visit would be taped. Some would say that knd of " cooperation " would trigger feelings and a backlash. They may be right; but, most often they also are the blessed who have not learned the cost of " cooperating " without legal safeguards and who have not lost, temporarily or permanently, their never abused of neglected children. Might your child be taken into " protective " custody for anything from full body x-rays or a first gyn exam or never administered vaccines? Yes. The best bet is to have your attorney contact NCADRC (National Child Abuse Defense & Resource Center at NCADRC@... or 419-865-0513 to learn of other attorneys in your area that have attended the group's Intl. Conferences and aware of particular experience in the state. > > > > Hey All! > > > > I need some help here. Long story short, I was a whistle-blower at work and ticked some people off.
