They got called on me when my DD was 9 months because we don't vax, i didn't want to sign the APA form, and I don't believe in feeding solids before there are teeth to break down the food.... Long story short....the case got dropped as soon as it was opened. I had a second opinion as the first doctor said my daughter was failure to thrive (she wasn't) and we explained that have an exemption for vaccines. That didn't even become an issue. If you have an exemption form, that shouldn't any issue at all. That is NOT the reason they are there. Keep the issue to the teeth and let it stick to that. Share as little information as you can. Clean the house and make super healthy food that day (not that you don't normally!) and be friendly and you really shouldn't have a problem. But again....keep the issue the teeth. Can you find a " holistic " dentist in your area that you can explain the situation to who might even see you as a second opinion for free or something? Capping baby teeth seems ridiculous..he's just going to lose them soon anyway. I just read an article about this too. I'll try to find it. Do a search on capping baby teeth and print it out and be ready and explain that you have done your research and feel that this is not something you want to do if that is what you guys choose. The issue is the 3 year old's teeth. That is it. Not with any of the other children at all. Keep the issue as the teeth and then nothing else can be brought up for the most part. Did you just recently go to the dentist? It was an anonymous call then? When this is done and over with, you have the legal right to get all the paperwork from the " investigation " . I did. They will black the names out but I knew who called for me. I know you're scared and nervous; it was one of the worst times in my life for that week that our investigation was taking place, but try to be confident in your decisions and do not make decisions off of fear. If I had a lawyer i knew I would have you talk to them just to know your legal rights. Do you know any lawyers? Anyone else know of any lawyers that could give some advice? Guest guest Posted June 28, 2009 Report Share Posted June 28, 2009 A friend recently had a dentist tell her she'd have to get several of her 3-year-old's teeth capped, etc, and it would require general anesthesia to do so. She called her husband horribly distraught (plus, she was 8 months pregnant at the time!), and he calmly reminded her that they're just baby teeth that'll fall out, and that's really stupid unless they're causing problems. So, she simply took him to another dentist who explained the " issues " and that they're fine to do nothing right now, but there were a couple of grooves in his molars they'd keep an eye on. I think a new dentist would be a great idea just for the back-up confidence for you right now. Otherwise, stick to your guns. You have done NOTHING wrong and are NOT risking your children's health in anyway. I know too many people who have gotten visits for absolutely no reason and I live in fear of someone calling on me for similar reasons -- not vaxing, etc. Useless things. If you can avoid the subject of vax entirely I would. If they insist on discussing it, I'd have a copy of your state's laws and tell them that you are perfectly within your rights to choose NOT to, and that if they vaccinate your kids against your will (whatever excuse they would make up to take them) that you WILL be pressing charges. No one else has the legal right to make that decision for you! I have never faced this but if your state's laws clearly say that you can choose an exemption (and you have) and someone tries to take that right away from you, I think you can press charges...and you can sure try. But, if you can just not discuss that I think you're fine. Typical dental sealants contain bisphenol A (BPA) that is known to cause developmental and reproductive problems. The Fed and State governments are trying to ban this in products meant for children. Tell them you don't want this in your child's mouth, constantly exposing him. I haven't agreed to the sealants yet either for jessica. I can get stainless steel caps but they're more expensive and look uglier. FYI--my youngest son had the same problem with his top four teeth. Never had a bottle, nursed for 7 years. I've traced it to the stupid antibiotics he was given during his first year of life. You don't have to let them in. They can not enter your home unless you allow them in OR they have a warrant to enter. I have heard from others that if you let them in, it allows them to snoop around. Personally, I would talk to an attorney, if you have one available. If you do talk to them, I wouldn't tell them much of anything. SIMPLE answers and no details are best. Have your state law printed and ready for her to read. Practice what you are going to say and be confident. She will probably try to be nice to you to get you to open up and start speaking freely, don't let it happen. I would not get too into your beliefs on doctors or medicine, this raises a red flag for them, although it makes sense to us. I would not get into the negative effects of vaccines, as she probably knows the counter arguments and will use them, which may upset you. Did she say that she wanted your children to be there? Find a dentist who is more laid back and less likely to want to do extensive work on baby teeth, maybe someone older. It could at least buy you some time. I really think this is comparable because social services show up at homeschoolers' door over complaints of neglect and abuse. They do not have the legal right to enter--although they state and act like they do and sometimes they leave and bring the police back with them. But for someone who knows the law, or better yet, has a lawyer to call when they arrive at the door---then hand the phone to the lawyer and let him explain the law to them----they always send SS back to their cars. They can go try and get a warrant--but no judge is going to issue a warrant over rotted baby teeth alone!! But if you let them in, they are very good at finding other things to use against you. I know you think that you should be nice etc and " be nice " but letting these people in without a warrant--is a mistake. be nice but do not be unwise. You are only in the power seat as long as you do not let them in. No judge will issue a warrant for this alone. I belonged to a legal firm called HSLDA for 18 yrs as we homeschooled---they always warned members not to let them in without a warrant--and to call HSLDA (Homeschool Legal Defense Association)from the front door to speak with them. In some cases, they have said to let SS " see " the other children for a moment on the porch--in order to show they are fine and there is no " immediate " danger to the children--which is what is needed for the warrant. This does not mean the children speak anything but hello and that they are fine. They are not to be examined and you are in charge of controlling that. You could say something like, " Well, you can see the children are healthy , happy and fine, so I am sending them back inside now. " Stand your ground. Hopefully they won't act scared either! This all needs to stay limited at your front door, a witness would be good, a lawyer very valuable here in this situation. Another thing that was often done in stories of harassed homeschool families was that several letters were quickly gathered--- attesting to the good, safe care and home of your children. Family members, a pastor, a teacher, a neighbor, a doctor, 3 neighbors,other close friends, an employer etc......have copies of these in hand if this looks to be going south. I am not preaching, just sharing what I have seen advised in similar situations. You and oyur husband need to be united here also. Save your differences for privacy. That's why you have the right to having a lawyer present for questioning--to protect you from being so honest that you could legally incriminate yourself. Don't let her in to find other stuff to use against you. Why is she coming back at all? DO NOT DISCUSS VACCINES. Do NOT discuss your religious beliefs. You do not owe this stranger any explanations about your parenting choices. Guest guest Posted July 1, 2009 Report Share Posted July 1, 2009 I read once that you should NEVER answer the questions of the police or anyone without an attorney present, even if you think you have not done a thing wrong. I.e. a police officer walks up to you in the grocery store and starts asking random questions that you would normally blow off if it were anyone else in the grocery store check out line... DON'T answer them. The piece I read showed how the most innocent of conversations can be totally turned around and used against you if you don't have someone watching your back. I certainly don't want to make anyone paranoid, but I think it's very good advice to have an attorney present while being questioned, or at the very least, have him/her listening in on the phone. I would certainly call Alan BEFORE the visit and get his take on all of this. He bills on a sliding scale and tries really hard to keep his fees reasonable. He's not just a family lawyer, but a family lawyer that is well versed in the law as it pertains to vaccines (so he could help with the teeth thing, too).
