West Virginians for Vaccination Exemption

Demands Amendments to SB439

ton and Fairmont, WV - West Virginians for Vaccination Exemption

(WVVE) are holding two simultaneous protest rallies today to demand

amendments to Senate Bill 439. The protests will be held outside the state

capitol in ton, WV and outside the n County Courthouse in

Fairmont, WV from noon to one o'clock. Human Life International and other

religious freedom groups will also participate in the protests held in

ton. Homeschooling parents will be among the protesters in Fairmont.

Senate Bill 439, introduced by n County Senator Roman Prezioso and

on County Senator ph Minard, will require that " each child " have a

record of compulsory immunizations, and " any parent who does not permit his

or her child to be immunized " face a criminal charge. If enacted, this bill

will make West Virginia the first state to punish homeschooling parents for

choosing not to vaccinate their children for religious and philosophical

reasons.

The bill will also remove the ability of a physician to exercise individual

judgment, by forcing him or her to grant medical exemptions for only

" commonly accepted practices, " which are very limited in scope. Jane

Orient, M.D., of the Association of American Physicians and Surgeons, has

condemned such legislation as the " government practicing medicine without a

license. "

Hepatitis B and chickenpox vaccines will be added to the list of mandatory

vaccines. The chickenpox vaccine is manufactured with human cell cultures

obtained from abortions, and is objectionable to many parents for religious

and philosophical reasons. Parents also object to being forced to vaccinate

against Hepatitis B, a disease their children are extremely unlikely to

catch. West Virginia and Mississippi are the only two states that do not

allow religious or philosophical exemptions from mandatory vaccinations.

WVVE demands that SB439 be amended to 1) include religious and philosophical

exemption from all mandatory vaccinations, 2) eliminate all penalties for

parents who choose not to vaccinate, 3) require vaccinations only for

children attending school, 4) restore physicians' right to exercise

individual expert judgment in issuing medical exemptions, and 5) eliminate

the state's " compelling interest " that supercedes parental choice and

requires compulsory immunizations for " each child. "

" If passed, this bill will turn all West Virginian parents who choose not to

vaccinate for religious reasons into criminals or force them to move to

another state, " says Helen Tucker, co-founder of WVVE and state chair of the

Libertarian Party of West Virginia. " It presents an unprecedented attack on

parental choice and religious freedom. It is not only an insult to free

Mountaineers, but it treads on all rights we hold dear in America. "

WVVE is a coalition of concerned citizens who believe informed consent is

required for all vaccinations, which are medical procedures that carry risks

of injury or death.

A devastating bill has been introduced in WV.

SB439

-eliminates medical exemptions where a physician can use individual

judgment

outside of " commonly accepted practice "

-adds hepatitis B and chickenpox to the list of mandatory vaccines

-require the use of new " certificates of immunization " to document

vaccination history

-increase penalties for noncompliance establishes " compelling

interest " for

the state that supercedes individual choice.

-Homeschooling parents who do not vaccinate will be convicted of a

misdemeanor and fined up to $500 each.

The bill reads:

Any parent or guardian who refuses to permit his or her child to be

immunized against the diseases enumerated in subsection © of this

section,

or who cannot give satisfactory proof that the child or person has

been so

immunized or who falsifies a child's immunization record is guilty of

a

misdemeanor, and, upon conviction, shall be fined not less than one

hundred

dollars or more than five hundred dollars.

[Note: It does not say any parent of a child attending school. It

says

" any parent, " period.]

HSLDA has posted a summary that says this will affect homeschoolers

as

well.

SB439 has already passed the Senate HHR Committee on February 19,

2004. It

is expected to pass the Senate floor and House committees next week.

Our

efforts at lobbying to amend this bill to include religious

exemptions have

thus far been intentionally thwarted by politicians who have made it

evident

that they do not want to hear from their constituents. They have

scheduled

votes at the same time our lobbyists are at a rally. They have

refused to

answer direct questions. They have scheduled meetings with

constituents and

then stood them up. They are dead set on passing this bill, and they

no

longer care what their constituents have to say about it.

Our only recourse is to go to the media. We need to lobby the media

as hard

as we would have lobbied our legislators, if they would only listen

to us.

Write letters to the editor. Write press releases. Talk to local

reporters

about this very dangerous legislation that subverts our parental

right to

choose what is best for our children. Create such a media uproar

that these

politicians will not be able to ignore our voices any longer.

I would like to know how many people can attend a protest in

ton next

week. We need a good 30 people to set up a PA system, hold a press

conference, and get media attention. We need good old-fashioned

picket

signs. Now is not the time to sit back. Our parental rights are in

imminent danger, and we need to act.
