AAPS Support Yurko Case

Dear Yurko Project supporter,

Great news! The Association of American Physicians and Surgeons (AAPS)

http://www.aapsonline.org with a membership of several thousand private doctors,

has has stepped up to the plate in the Yurko case.

At their annual meeting in Orlando, Florida (18-19 January 2004), AAPS

voted unanimously to submit an " amicus curiae " brief (volunteered opinion

or " advice " to the court). This will add immeasurable support for the

evidence accumulated since the conviction that demonstrates Alan's innocence.

AAPS is one of over 115 organizations around the world committed to

Alan's release and to bringing reform to issues of vaccine safety and

medical error.

The case approaches resolution with an upcoming evidentiary hearing in

the courts. The office of Judge C. Alan Lawson contacted Alan's attorney

on 19 December 2003 to advise him that an evidentiary hearing had been

granted, but that the date had not been set.

A 16 January 2004 letter to Alan from his attorney indicates that some

additional legal wrangling by the State Attorney must still be addressed

before the date can be arranged. So apparently things are a bit more up

in the air than thought. Such is life in the justice system. However, the

support of AAPS strongly reinforces positive results. We will keep you posted.

Meanwhile, this " delay " gives us more time to raise needed funds, and all

YP supporters are urged to continue the fund-raising effort. If you have

Dear Friend,

Alan Yurko has been in jail for 6 years, falsely convicted of killing his

infant son by shaken baby syndrome (SBS). Before his false arrest and

conviction, there was little help out there. After his incarceration, the

Yurkos began their trail-blazing odyssey of researching SBS and

contacting professionals to review the case. In that time, the case has

gained international attention and recognition in newspapers and other

publications---including a number of medical journals---and on the

Internet. Due in great part to the Yurkos' and their supporters' efforts,

help is growing.

Although the work the Yurko Project and others have done has already

helped prevent many convictions, very few false convictions have been

reversed. At any rate, no case is as " notorious " as this one, especially

with regard to aspects that so sharply outline the medical malfeasance

involved in such cases, including the apparent motive of harvesting

transplant organs. Therefore, the international reverberations from

winning this well-known case will help greatly to expose the problem and

pave the way for many other reversals and preventions.

likelihood of another equally propitious opportunity remote. Based upon

what we can only imagine the post-vaccinal suffering of that small,

fragile life to exemplify, not to mention the misery visited upon his

loving family, we---professionals and lay persons alike---must not relent

in our insistence upon measures to prevent such tragedy. To this end, the

Yurko case must be won. No other outcome is thinkable. "
