Work Woes Update

To those of you who follow my posts about (my hubby with

DES), I wanted to let you know that he was officially fired from his

job just over a week ago for missing time with severe spasms :( . In

some ways this is a blessing since we felt the stress of his work was

making the DES worse, but it's also depressing for him and scarey for

me (I worry about our finances).

We talked to some attorneys one day last week about his case. One

was supposed to be the best in our area for employment issues. She

said that he doesn't have a case against his company for wrongful

termination (firing him because he's sick). The psychologist that

has been seeing told him that he would definitely have a case

against his company for worker's comp, though. He said that he has

documentation that the stress from his job caused his DES to get

worse, to the point that he couldn't work (not very often, anyway).

We'll have to mention this to his local GI doc, too, to see if he

agrees that the stress may have caused his condition to worsen. We

discussed this with another attorney (who deals with those issues).

He said that cases that involve stress-related illness are hard to

prove. He said that it would probably take 18 mos. for a lawsuit to

go through and 18-20 mos. for a Social Security Disability claim (if

he chose to file for that). He said that in order for to get

Unemployment payments, he would have to get a letter from a doctor

saying that he is fit for work, BUT if he did that it would hurt a

lawsuit for workers' comp. or a disability claim. He advised that we

wait 6 weeeks and see how is feeling to determine if he could

just look for another job at that point.

saw his internist last week who reluctantly gave him Valium

to take for the next month (it was his psychologist's idea) and also

Paxil. He had told the psychologist that he kept replaying his work

problems in his mind. It was definitely keeping him awake at night,

too. I hate to see him spaced out on the Valium, but I'm hoping

between the 2 drugs, it will help him through a tough time. In the

meantime, we wait to see if things will improve enough for him to work

again or if we have to pursue the lawsuit or disability claim.

I will try to keep you all updated on the legal issues as it may

apply to someone with A who is unable to work, as well, although the

laws may vary state to state and certainly in other countries. Take
