My DILEMMA

I talked to two new agencies today, one I found and my advocate found. Was

unsure which one to pick as I knew nothing of either. Both were willing to do my

strange hours. I picked the larger of the two because one only had 12

employee’s and I was concerned about call-offs and backup people. He even

hired some of my girls from the old agency, so that was good. Hope I made the

right decision, we’ll see I guess. Gonna try and relax a bit now, been a very

stress filled week. Take care all, Doug

Doug,

This is certainly a horrible situation. I am glad that you seem to have found

sort of a solution, but it still sounds precarious. Even though you are okay

right now, you might look into legal and media options if you get dropped again.

It is one thing for a vendor to go through the process of not handling your

case, but they need to be fair and reasonable.

There must be other PWDs in your area that have experienced similar actions by

the vendor. This sounds like a story tailor-made for television. At least here

in New York City, there are a number of reporters which specialize in consumer

and governmental nightmare stories. They would eat this up!

As for legal strategies, I am predisposed towards suing. Sorry, it's the lawyer

in me and I am sure that there are underemployed lawyers in Michigan somewhere.

Even if you can't find a lawyer, you can represent yourself and, sometimes,

simply threatening a lawsuit works.

Please keep us posted,

T.K. Small

They said their making no money on my case, and don't want the responsibility of

my care. I have called tons of home care agencies and none will take me because

the state pays so little ($13.50. I believe the state will pay a care giver

directly, but am having difficulty finding info on it, and my case manager is

one of those social workers who doesn't answer their phone or email. Where do

you find good pca's who will only work for $8 an hour? I'm so afraid of being

institutionalized or placed in a group home. How do you all find and pay for

help? Thank you Doug

I am all set up with the new home care company (Right At Home), with one on the

backburner ready to go if things don’t work out. So nice to have a little

peace of mind again (I will always worry alittle lol). My social worker is

looking into actions we can take, she has already reported them to the parent

company and gave me the number (Michigan Protection and Advocacy:

1-800-288-5923) where I can file some sort sort of complaint. I don’t want to

make to many waves right now because some of my girls are still employed there.

The ladies apparently sign some sort of agreement about working for two

company’s, not sure what it is. The owner can sue or something. BTW my former

agency was Comforcare in you want to be wary of them, don’t know if their

national or not. Thanks for all the help and support, Doug
