RECENT SUCCESS STORIES

1.. The United States Department of Justice has joined Attorney

H. Farley, Jr., in a Federal Class Action lawsuit against the State of

Illinois for failing to continue the same level of nursing services when a

medically fragile child turns 21 years of age. To date, the Federal Court has

entered 15 Court Orders to continue nursing services past 21, pending the

outcome of the case.

2.. The Naperville Park District agreed to change its decision

barring children with disabilities from attending an all-day summer camp in the

afternoon after children first attended summer school (extended school year).

The American with Disabilities Act (ADA) requires the Naperville Park District

to modify its programs to serve persons with disabilities. Note: The Naperville

Park District’s attorney stated that this change would be only for one year.

Attorney Farley’s Note: Does this mean that the Naperville Park District will

not have a summer camp for 2012? If it does, then my clients are entitled to

participate under federal law.

3.. After attending a Workshop a family learned how to handle

Guardianship on their own and the money which they saved allowed them to

establish a Special Needs Trust so that the funds in the Trust would not make

the disabled child ineligible for government benefits.

4.. A family was successful in obtaining Home Based Support

Services from the State of Illinois for their two developmentally disabled

children without resorting to litigation, after attending a Workshop. Prior to

attending the Workshop, the family had been told that they could not obtain

funding. After the Workshop, the family followed the strategy outlined by

H. Farley, Jr.
