Participating will not change your eligibility but it would be much appreciated, as this case could still potentially fail to achieve the desired outcome. Ellen Actions Related to the Ligas v. Hamos Proposed Consent Decree Background: Under the proposed Consent Decree in Ligas v. Hamos, people with developmental disabilities living in private ICF/DDs with 9 or more residents who have a “current record” of wanting community services would be given the opportunity to move into the community. (All ICF-DD residents who are happy with their current placement would not be part of the proposed class and would not be required to move.) In addition, 3,000 people with developmental disabilities living at home awaiting services would also be given community services over a six year period. Submitting Comments: Class members have the opportunity to submit comments to the Judge about the proposed Consent Decree. If you want to submit comments to the Judge, you must do so by May 13, 2011. If you want to speak at the Fairness Hearing, you can include this request with the comments that you send to the Judge. It is up to the Judge whether you will be given the opportunity to speak. Class members are not required to submit comments nor are they required to attend the Fairness Hearing.
