Guest guest
I don't have any advice since we just started receiving SSI but I'll certainly keep this in mind and pay attention to what others have to say. I keep getting letters asking me for pay stubs for which I've sent to them 2 or 3 times now. I hope you get this resolved quickly!! H. SSI Being Terminated, Need Advice Thanks to checks written for my daughter's needs that took awhile to clear, everal months of her combined accounts exceed $2000. Some by only a couple of ollars. I received a Notice of Planned Action that tells me that her SSI is being topped as of March 2011. I would appreciate any advice on how I can appeal this. Guest guest
Hi , First off, sorry to hear this has happened. Secondly, get out the letter you received and study the appeals instructions. This has happened to us twice as we were paying wages thru Helper Girl. The first time I was able to call within 10 days of receiving the notice, just talk with someone on the phone, send them proof of paystubs, and then they corrected it. The second time it happened it took a phone call and a visit and completing a form (which is available online or at your local office) describing the reason you are requesting 're-evaluation of the decision'. But once they get the supporting documentation showing her bank account is back down under $2000, they should reinstate her no problems. Depending on the circumstances surrounding the checks being written but not cashed/processed/cleared, they may or may not penalize her payment amounts for that time period. Either way, you should be able to get her SSI back to the normal rate. At least this was our experience with the Aurora office. I've heard from other people that Social Security can be a bear to work with, but we haven't found that to be the case. Also, fyi, it's a really good idea to establish some kind of relationship with one particular person in your local office, if you find they are helpful...write them a thank you, write their supervisor a thank you, anything to help them remember you...and then ask for them next time by name. I have a 'friend', Mrs. ez, at the Aurora office who told me last time we spoke that I should consider putting in an application to work there. Hope this helps. Guest guest
Thank you Laurie. This is what I've found out. When I first opened Angel's savings account, a $300 minimum was required so I transferred money from my savings into hers. I have her info on QuickBooks and this is recorded as a 'loan' from me. I just repaid myself. This takes care of many of the months where it's only a couple of bucks off. The other months - every single one had two deposits from SSI, the first and the last day of the month. These months, I did not pay rent the same days. Also, each one if these months had outstanding, uncashed checks. Now, instead of writing a check from her to me, I will use the online and transfer the money to make sure her end of month/beginning of the month balances stay lower. I have no control over the other uncleared checks. Many times, it's a large amount written out to the SRA for a season worth of programs. > > Hi , > > First off, sorry to hear this has happened. > > Secondly, get out the letter you received and study the appeals instructions. Guest guest
, Once it goes a few cents over $2000, the computer indicates a problem. I suggest getting an appointment at the local office. Also put in writing a request for an appeal. The first time they will usually work with you. Be kind. Be patient but be quick and persistant. You do not want to lose SSI. I am sure you will be okay if you contact them soon. Guest guest
Thanks . Some of the months, it was only over less than $5. You would think that the SSA would be in some sort of tolerance for small amounts because I would imagine the appeals process requires a lot of their resources. > > Thanks to checks written for my daughter's needs that took awhile to clear, several months of her combined accounts exceed $2000. Guest guest
Hello All, I agree, Laurie, you should be working for SSA! Both Laurie and Ficker-Terrill have provided some extremely helpful tips, particularly the advice to build a relationship with your local SSA office! , responding quickly to letters from SSA is very sound advice. In the meantime, the document that Laurie referred to about your right to appeal (Request for Reconsideration) can be found on the SSA website at: http://www.socialsecurity.gov/online/ssa-561.pdf By checking 'Informal Conference' you will be called for a meeting where you can show the bank statements and receipts. Please know that if you receive a Letter of Overpayment and the overpayment amount is less than $1,000, you have the right to request that the overpayment amount be " administratively waived " . You can make this request at the local office. There are options for handling overpayments: Reconsideration; Request for Waiver; and lastly negotiate a repayment plan! Good Luck, . Marsie Marsie L. Guest guest
We were having terrible problems with mailing in the check stubs to our office. They were constantly taking too much from her, then crediting her back. It was a mess. I was finally able to get to an automated phone system that I called in the amount of all her checks once per month on a touchtone phone. Life was simple after that. She has not worked for the last year so I don't know if it is still available but I suggest you ask. You don't have to wait to talk to a person and you don't have to mail in the checks,. Guest guest
Marsie, thanks for the info. I've already filled out the Request for Reconsideration form (except I didn't select what type of meeting). Since you recommend the Informal Conference, I will pick that one. I am going to prepare a more detailed document to address each one of their Ineligibiilty issues. > > Hello All, > I agree, Laurie, you should be working for SSA! > Both Laurie and Ficker-Terrill have provided some extremely helpful tips, particularly the advice to build a relationship with your local SSA office! > , responding quickly to letters from SSA is very sound advice. Guest guest
We have used certified mail, we get a receipt back. This in no way affirms what was in the mail, only that something was sent and recieved. Every few months someone from SSA calls and says we have not sent in our papers, we ask them to keep looking because we know they are somewhere in the Aurora office. Adam's is apparently complicated because he has three very part time jobs. We have been told we can fax the receipts, however other SSA types have said if there is more than one employer we cannot fax or call in. We think we are pretty organized. Each month has its own plastic page in a thre ring binder with work receits and Income Related Work Expense Each binder is a year's worth of paper work. When SSA calls to question we go to the right year, he has been working 5 years, the right month and we can go receipt by receipt. One of his employers is a college, which took several weeks off in December. No receipts for that period of time. SSA called us on that claiming we did not send in all the necessary receipts. I explained we were not holding out, he just does not work when the college is closed. SSA told us next time write a note explaining the missing receipts. I will never be able to second guess what unique questions or misunderstandings they may have. . .
Guest guest
I send in a sheet of paper with my son's name and the month and ask that they sign and return the stubs each month. My SS person told me they are so busy and backed up and asked that I send them in every 3 months instead of every month. We will see how that works as they did not return the last two months I sent. Guest guest
There are two different methods for overpayments: 1) Reconsideration - fancy name for appeal.    You do this when you think Social Security is wrong 2) Waiver    You do this when something is not your fault and it is a hardship to pay it back If you lose, ask that they take 10% from future checks. They will do this. FYI - if you are using Employment Related Work Expenses to help reduce your earnings, you cannot use the telephone reporting. ________________________________ From: " cathyfickerterrill@... Guest guest
I use certified mail with the green signature receipt. This way, I have proof that someone in the Social Security office has signed for them. I keep a copy of everything. That way, I have a copy of what was sent and who signed for them. Usually, after the claims representative enters the earnings in their system, a letter is sent out to the recipient and to the payee stating the income has been received and if/how it affects benefits going forward. ________________________________ From: " krazykato3@... Guest guest
Marsie and others won't like this statement, but it's stories like the ones shared here on IPADD this week that make me understand, or at least empathize, with parents who throw up their hands and say 'enough!' and 'ok, my kid just won't work'. When you're dependent on Medicaid for so many things, it can be a scary thought to be on the brink of losing that benefit. Not to mention the SSI or SSDI if you are financially dependent on it and your work history is patchy. You're right, Donna, the paperwork IS like having another job. Do people on regular welfare have to jump thru similar hoops, I wonder? I know my inlaws and parents, at least two of whom never worked for pay a day in their lives, get their Social Security checks like clockwork, and no one questions them 'Are you still OLD?' and 'Send us proof every month'. Guest guest
People on welfare can do whatever they want with the checks and they don't have to file the annual reports that we do. What aggravates me is that the $2000 asset check is applied monthly. In our case, uncleared checks and two SSI deposits (first and last of the month) have caused our overage. My checkbook balance is always below. I also believe they should use some sort of tolerance, like maybe within $15-25 dollars. I have one month that is $3 over. What a waste of SSI resources to make a recipient not eligible and then go through the expensive appeal process! Obviously, they expect us all to use online banking and on the last day of the month, to check the balance and use online pay to keep it under. If I had taken out two room and board payments with I received the two SSI deposits, I wouldn't have gone over. The R & B payments are automatic online for the first of the month and if it falls on Saturday, Sunday, or a holiday, it still comes out on the first. SSI will be deposited the day before Saturday, Sunday, or a holiday, thus giving the recipient two deposits in one month. > > Marsie and others won't like this statement, but it's stories like the ones shared here on IPADD this week that make me understand, or at least empathize, with parents who throw up their hands and say 'enough!' and 'ok, my kid just won't work'. Guest guest
Folks, Can I ask how the SSA has such current info on the balance's in one's bank accounts that they could detect an overrage that existed for only a day or two?? I could see them having info on the account that the SSI is deposited in, but if a recipient has more than one bank account, say for example, to deposit earnings from a job, does SSA have this info as well? They would have to add the balnces from both accounts to do the asset test. How can they possibly have the resources to monitor this? > > Thanks to all who have contributed to a substantive discussion of troubleshooting SSI problems. Guest guest
Lenore, they have everything. When you receive a 1099-INT, the bank also sends the Department of the Treasury a copy of it. A copy of your W-2 gets sent to SSA. When you apply for SSI, you are supposed to list your assets, so they know if you have a savings account and checking account and thru the wonderful world of computers, obtain that information. In my letter, SSA listed the end of month bank balances (IOW, the uncleared balance) of both the savings and checking account. What they did not do is take into account when they direct deposit the SSI the last day of the month instead of the first day. This could easily be done by computer and eliminate a lot of unnecessary appeals. > > > > Thanks to all who have contributed to a substantive discussion of troubleshooting SSI problems. Guest guest
Yes. They really do check that every month using a computer automated system but don't check it regurally if it involved with a live person. Social Security needs to be automated in a electonic form fashion like e-File for annual tax return. I told my friend who a mother of a daughter who collect SSI for CP and Asperger Syndrome about the termination of SSI. She ask, " didn't she put the money in the mattress? " . I would have done the samething. Bank account has to be clean oncewhile each month. > > > > Marsie and others won't like this statement, but it's stories like the ones shared here on IPADD this week that make me understand, or at least empathize, with parents who throw up their hands and say 'enough!' and 'ok, my kid just won't work'. Guest guest
Well that's the scary question, isn't it? Our experience was once having receive a paycheck in the same week she received her SSI benefits, thus putting her at about $2100 in her bank account. And yes, we have two separate accounts, one rep payee that gets the SSI direct deposited, the other a separate account. I got a call from my 'friend' at our local Social Security office, about a week later, saying that 's name had showed up on her 'watch' list (that's what she called it) and that anytime a person's assets go over $1600 her office or SSA issues a watch list for fraud purposes. I don't know if any of this is true (maybe someone else here does) but the fact remains that she KNEW within a week. Computers apparently talk with one another. Maybe we sign away our privacy rights when we apply for SSI, there's a lot of fine print. Maybe someone else on list knows the real story. I'm just guessing! L.
