Guest guest
I hope he rots in hell. Pam HB 758 Allan Bergman sent me this for distribution: You will recall that House Bill 758 would have directed all captured DD and MI Medicaid reimbursement to go back into community DD and MI programs through their dedicated funds. Today Governor Quinn amendatorily vetoed the bill--not changing its intent, but the moving the implementation date to 2012 because of the state's fiscal situation. Here is his message: August 11, 2009 To the Honorable Members of the Illinois House of Representatives 96th General Assembly Today, I return House Bill 758 with my specific recommendations for change. I thank the sponsors for their hard work and the members of the General Assembly for passing this bill. Furthermore, I recognize that many advocates and members of the General Assembly have fought long and hard for this change. This bill will ensure that reimbursement funds from the Federal Matching Assistance Percentage within the Community Mental Health Medicaid Trust Fund and the Community Developmental Disabilities Trust Fund are reinvested into care and services for persons with developmental disabilities and mental health issues. House Bill 758 is to be effective upon becoming law. However, during this period of unprecedented financial strain, any legislation that prevents funds from going into the General Revenue Fund (GRF) will pose grave problems for the State's immediate fiscal condition. There is simply no other way for the state to make up the lost GRF revenue at this time. Accordingly, I am recommending that the effective date of this bill be changed to July 1, 2012, in order to allow the state time to improve its financial health. Therefore, pursuant to Article IV, Section 9(e) of the Illinois Constitution of 1970, I hereby return House Bill 758, entitled " AN ACT concerning State government. " , with the following specific recommendation for change: on page 6, line 10, by replacing " upon " with " July 1, 2012. " ; and on page 6, by deleting line 11. With these changes, House Bill 758 will have my approval. I respectfully request your concurrence. Sincerely, PAT QUINN GOVERNOR

Guest guest
Hello everyone, I will try to respond to the concerns about Medicaid matching funds and how Medicaid works. This has nothing to do with Illinois politics and honesty. The way that Medicaid (Title XIX of the Social Security Act, which was enacted as health insurance and nursing home services for individuals of low income in 1965 as part of Lyndon 's Great Society) works is as follows: 1. The annual rate of the financial match is set by a formula based on population, per-capita income and several other factors. Illinois currently receives 50% match as do many other states. Some states receive a higher match. Under the stimulus bill, the matching rate for Illinois from last fall until December 31, 2010 is 60%. 2. Each state develops a Medicaid state plan which contains both mandatory and optional eligibility populations as well both mandatory and optional services. No two state Medicaid plans are the same and the states have great discretion in the optional categories. The states also have discretion in defining the " amount, duration and scope " of services to meet the definition of " medical necessity " . The Home and Community Based Services Waiver is an optional state plan service and the states have huge discretion in the services provided in its waiver. The state can amend its Medicaid plan with the federal government at any time.  The federal matching dollars are an open ended entitlement to the states. As states expand their Medicaid programs, as Illinois did with the Children's waiver, the federal government must provide the matching funds as long as the services are consistent with federal law and regulation and approved by the federal government (the Center for Medicare and Medicaid Services- CMS). There is no cap on the amount of federal dollars available as long as the state can provide its share. 3. Once a Medicaid service is provided, the state creates a federal claim. It then batches its claims and submits them to CMS. As an example, if Illinois submits a claim for $10 Million, it will receive payment from the federal government for $5 Million (except $6 Million under the stimulus law). The state then deposits the Federal matching funds into the state general fund. This is done in almost every state in the country since the federal government is reimbursing the state for the federal share of the total expense paid by the state. 4. Yes, Illinois has done a very poor job of protecting many of the federal Medicaid matching funds that have been garnered on funds used for services for individuals with disabilities; Developmental Disabilities; Mental Illness; Traumatic Brain Injury; Children who are Medically Fragile; individuals with AIDS; individuals with physical disabilities and individuals who are frail elderly. Although some federal dollars have been directed to trust funds in the past, the vast majority have been deposited into the state general fund. This is perfectly legal and the federal government has - and never will have - the power to tell states what to do with federal matching funds in Medicaid. The advocacy in a number of states has been more successful than in Illinois in dedicating a portion (50-80 percent) of the federal matching funds to a dedicated fund for the population that generated the federal revenue. Kathy Ryg's legislation, HB758, was an attempt to do this in both Developmental Disabilities and Mental Health. Medicaid is a very complex law and set of regulations and administrative guidelines. I hope this brief response is somewhat helpful and I will try to answer any further questions on this issue.
Allan Allan I. Bergman HB 758 Allan Bergman sent me this for distribution: You will recall that House Bill 758 would have directed all captured DD and MI Medicaid reimbursement to go back into community DD and MI programs through their dedicated funds.
