Sad or right?

Dear all,

Another sad (?) message from the Netherlands. Sad in the way that a man who has proven to do good work is forced to stop his practice as an alternative doctor. But I must say that I have also mixed feelings about it. This man, dr. Broekhuyse, believes like Hulda (by the way in alternative circles in the Netherlands Hulda clark is seen as a very dangerous woman who gives a lot of bad information and is seen as a treath for the whole alternative movement) that cancer is caused by a bacterial infection. Now I've heard that in a very few cases this can be right. But just in a very few cases and still than the people suffer from cancer. OK maybe caused by a bactery but still it is cancer. But the problem with dr. Broekhuyse was that he told every patient who came to consult him he told them you don't have cancer you have a bactery (first mistake in my opinion) . Then he sold them his own supplements and medicins (second mistake in my eyes, though the products weren't really expensive but still) and he gave those people in my eyes false hope to recover from their cancer (the worst mistake in my opinion). At the other hand this man was a very friendly man with as I heard from a lot of patients a warm way of communicating and also very well educated and he knew a lot about diets and other ways of alternative and complementary approaches. But now because the wellknown actrice (I told you before about her) consulted him and she died because she refused any regular treatment this doctor is forced by the inspection to stop with his practice.

Is this sad? To be honest I think no this is right, but at the other hand if a regular oncologist make a mistake nobody will punish him and all those regular oncologists can go on and on. That makes me sad that there is such a difference in approach. Though in the Netherlands things are changing like also the letter of the Lancet and other medical magazines does a lot of good to a more honest way of approach to alternative studies.

I am sad to report that Dr.Serafina Corsello,MD has received a decision from OPMC revoking her license. The decision relied SOLELY on failure of her lawyer to file a timely response to the charges. This reliance on the rigid technical reading of the Statute of Limitations may have been consciously caused by OPMC conduct. The original attorney in the case was replaced and the reasons surrounding that change bring to mind a similar early change of attorneys in the case of Dr. s. In the s case, the first attorney was explicitly threatened by OPMC with being reported to the Legal Licensing Authorities and being fined for bringing a frivolous action, if she persisted in bringing an action. In the Corsello Case the state appeared to schedule a hearing prior to the issuance of the specific charges being presented to the Doctor. IN BOTH CASES THE STATUTE OF LIMITATIONS was the basis for decisions unfavorable to the doctors. I do not have the details of the early contacts of the attorney in the Corsello case at this time. but it does appear to be a pattern of conduct, somehow deliberately causing delay beyond the date the statute prescribed. This way the State never has to even deal with the substantive charges. By not filing a timely response, the doctor is DEEMED TO ADMIT the charges as true!!

Doctor Corsello is appealing. In the meantime I was at a meeting in which we are planning a series of actions to potest this abuse of power by OPMC. Letters to the Governor will be drafted for you to send in a future Email. The Foundation for Advancement in Innovative Medicine (FAIM), the organization of Holistic Doctors in New York State is proposing legislation to more specifically spell out the due process procedural rights of doctors and probably more important provide for earlier pre-hearing conferences to hopefully resolve these issues before they gain the bureaucratic momentum that turns these cases into unduly adversarial proceedings. This legislation appears to have substantial support in the NYS Assembly. The NYS Senate is not as receptive. The Senate is controlled by the Republicans. It is EXTREMELY important if you live in New York State to contact your State Senator now and ask him to support reform of the Office of Professional Medical Conduct(OPMC). A bill will be introduced in January of Next year, but it is important to start building State Senate Support now. If you are represented by a Republican State Senator, it is especially important. Republican Senators in New York City are Senator Roy Goodman reoresenting the East Side of Manhattan south of 96th Street to 14th Street. Senator Goodman is extremely influential in the Republican Party. Senator Guy Velella represents the Nortwest Bronx. He represents Northern Riverdale East of Riverdale Avenue and North of 245th Street runnung East to White Plains Road. His district comes down to Van Cortlanft Park South down to Mosholu Parkway. In Queens Senator Padavan represents northen queens in Whiteside running into parts of Nassau County. Senator Serphin Maltese represents Richmond Hill and Glendale. On Staten Island Senator Marchi represents most of the borough West of Victory Boulevard running South to Richmond Road.

Senator Kemp Hannon of Nassau County is the Chairman of the Health Committee, but we have to work on convincing him of the importance of the issue.

Nevertheless, the best legislative measures cannot have the desired effect without the political will to assure the OPMC stop trying to go after alternative medical doctors the way they have in recent years.

At the New Life Expo we will be able to use a table contributed by Dr. F.Hutton,DDS who is also lecturing on Cosmetic Dentistry at the Expo. At this crucial time when Dr.Serafina Corsello has lost her license and the Office of Orofessional Medical Conduct (OPMC) has gotten out of control persuing alternative doctors we must impress upon Governor Pataki and Members of the New York State Legislature that it is important to support reform of OPMC. I will prepare letters and materials to be distributed. The Expo will be held at the Hotel New Yorker at 34th Street and 8th Avenue in New York City.The Expo hours are
