I'm with you. We have been fighting my sons bad conduct discharge for over four

years now. Everytime there is good news something happens to nullify it. So we

will be cautiously optimistic. is still considered active duty marine.

He is on appeallate leave at no pay of course. But we would like a resolution

one way or the other. Preferably an Honorable Discharge.

Just another little victory in this war....

I'm happy about this decision, but I'm not overly excited about it.

We have had this decision before and it was blasted. I won't hold

my breath until I am able to have my records cleared for refusing

and there is an ABSOLUTE decision on this subject.

So, I'll have a few beers in celebration tonight and email all my

family and have them continue to pound down the doors of their

sen/reps to get that bill passed...

Fortunately I wasn't discharged due to the refusal of the shot. I

was given and Article 15, demoted from E-4 to E-1, 30 days of

Corectional Custody and an $800 fine. After 2 years I was fortunate

enough for McClellan to close and since I didn't have sufficient

retainability, I was given the option of discharge. I received an

honorable discharge, but I still miss that 12k-14k that I lost due

to reduced rank.....
