Religious exemptions

For the record please realize my sounding off on religious

exemptions was in response to what I've been reading

over the last several months. I was (as is so typical with

me) several days behind in my e-mail. My post was by

no means intended as an attack on any individual who

requested religious exemption information in the last few

days (esp. as I didn't know any were posted.) Please do

however, take my first post as encouragement to stand up

for your rights with confidence, after all, ...they are your

rights.

They ARE your rights.

They are YOUR rights.

They are your RIGHTS.

Use them! :-)

Sheri and all those who helped me out with school exemptions for vaccinations,

I spoke with a mom-friend who is not vaccinating her son at all. She is

here in Nebraska and had to get the exemption for home day-care. Nebraska

has all 3 medical, religious, and personal exemptions and it's all in the

same paragraph on the form so that you don't have to specify which one you

are taking. She's going to bring me the form next week. It needs to be

signed an notarized. I won't be doing anything with it and will check to

be sure it is still current before I enroll nn in school, but it is

nice to know this information. Thanks for all your help.

Nearly ALL Children Can Qualify for the Religious Vaccine Exemption

There are, I believe, 19 states that currently allow a philosophical

objection to vaccinations for school admission. Thanks to the incredible

groups like the National Vaccine Information Center, it is likely more

states may be added. Texas is likely to make the total 20 in the near

future.

However, 48 states (all but Mississippi and West Virginia) allow for a

religious exemption. There has been a supreme court ruling on this issue

which provides broad interpretation of the meaning of religious exemption.

A parent's religious " beliefs " are sufficient to qualify for the religious

exemption. The " belief " is defined as a faith that occupies a place in their

lives parallel to that held by the orthodox belief in God or any sincere

religious beliefs which are based upon a power or being to which all else is

subordinate and on which all else is ultimately dependent

They qualify if they believe that not giving the vaccines is what they must

do to follow God's will for them in fulfilling their role as responsible

parents. Their child's immune system is a creation of God and that God has

given their child and that to vaccinate would violate their faith in what

God created.

The parents do NOT have to be part of a recognized religious organization.

You don't have to join any church, you can be any religion at all. But if

they are a part of an established religion (Catholic, Protestant, Islam,

etc.) they can still have their own perceptions of what it means to follow

God's will which may be counter to what that organization states.

The case is established with legal precedent at the US Supreme Court level.

The important rule here is that if a school district denies religious

exemption they are violating your federally protected civil rights under the

first amendment by what is called state action and under federal law you are

entitle to money damages.

Excellent post on this touchy subject.

We have 11 children and none of them have ever had any problems with the

school systems about not being vaccinated. I believe that too many people

want to be argumentative with the bureaucracy and too intensive in their

denials. That is what gets them into trouble. All the bureaucrat wants is a

piece of paper so their paperwork is correct.

I tell everyone who asks to find out who it is who is responsible for

tracking vaccination/immunization - typically the county health department.

They will usually have a form, or ask you to simply write out your request

for religious exemption.

Then on the sheet they should write:

Due to my deeply held religious belief I hereby claim exemption from

immunization for my son/daughter (name). Signed.

Too many people want to argue the point, and I have found that the more you

give them the more you threaten their status at the health department.

Therefore, a simple statement as above is more than sufficient, does not

ruffle feathers, and gets the job done.

I hope you are right about Texas allowing a philosophical exemption

soon. Have they taken a poll of the legislators here? I responded to

Dawn request to call the representatives of our district, and

that time the offices said they hadn't received many calls of this

nature if any. I urge all Texans to poll their representatives and

educate them about the controversy and potential risks to some infants

and children, and to encourage them to sponsor or support a concientious

exemption in Texas. C.

The only problem with claiming a certain religion though is, if you're taking a child to the doc at all, you can't really claim CS because they don't believe in any medical help whatsoever (ie: doctors, etc). You just have to be very careful, I mean, there are so many religions in this world, no one can really try to make you prove what you are and how you believe anyway, right? KWIM? =)

This is WAY GOOD advice, because if you state a certain religion, like Church of Christian Scientists, etc., you have to realize that they don't use ANY medications...

Can I ask you how you answered them? Did you just say no and leave it at

that or give a little bit more info? <sigh> the one good thing about being

in DE was they had an easy exemption, being in NY with them taking children

away is scaring me. Does anyone know if these parents had claimed exemptions

that were ignored?

Also, I was asked by the superintendent of my sons school, if I belonged to

one of those "paper religions" so they are looking for the Christian Scientists

and "those" religions.

Brooklyn, etc.), but I'm sure upstate NY has had it's share as with the 77

children in Utica, NY.

I said it wasn't one of those paper religions and said it was the

" Religion " and went into about 20 minutes of explanation,

how I thought our bodies were temples and we shouldn't have

other animals and chemicals put into our bodies and I myself have

never taken any vaccines when I was given the choice. My mother

was big on them all. I almost quit a job because of them wanting me to get

the Hep B vaccine, but they put down I was afraid of needles.. for me to get

out of it.

I explained we should have faith in the " powers above " and not put all that

crap in our bodies. I just went on and on.

Was there ever any proof that the parents were threatened in any of these NY

cases with losing their children? I remember that for a time we weren't

Parents all over NYC have been and is being threatened by ACS with removal of

their children. I guess the families have court documents to prove it, not

to mention hundreds of dollars spent on lawyers.

My experience with Christian Scientists:

During a conversation with one of the members, (about 9 years ago and this

was in Virginia) the topic of vax exemptions came up. I was told that they

often got officials (not sure what the titles were, Health Department I

think) coming in to " check up " on memebers who were claiming religious

exemption as members of the church. Apparently, you could not just join and

claim them. You had to be a regularly attending, active member of the

community for them (the " officials " ) to consider your exemption.

Since being on this list, I have of course learned that the rules state

otherwise, but this is what they told me. It looks like, even though you are

right in your claim, you may still have to fight for it.
