Guest guest
Gee, I knew what my rights are and did what I was suppose to do and my son was still denied admittance. I think what it all boils down to is not so much Ignorance of the law, but how much a parent knows about the law to pursue the matter in court, or how much money a parent has to pay a lawyer to do it for them. The school and board members ignore the law until they get a call from a lawyer. I plan to bring my son back to school with a member of the press and watch them physically PUT HIM OUT because he's a threat to public safety. We are citizens of our state, not the Federal government. Therefore, each state can legislate for it's residents only. For instance, I am in Minnesota where I have the right to choose. If we end up in some state, say Wisconsin (which is conceivable, and I don't know their law there, this is just for discussion's sake), and we have to go to the hospital, it doesn't matter what Wisconsin law says. Because I am a citizen of Minnesota and therefore, they must abide by my rights in that state. this follows for other issues, such as marriage. A marriage may be legal in one state, but not in another. So, if you were legally married in one state and move to a state where your marriage may not be recognized, that state must recognize your marriage, because you were legally married in the state in which you resided at the time (don't ask me about las vegas). As long as you are NOT a resident of the state, they can not dictate certain things to you. They can tell you how to drive (no right turns on red, etc.), but that's about it. When you're a visitor, you are allowed to stick to your personal issue guns. In a nutshell, and I don't think I explained that too well. My point is, carrying an exemption letter with a notarized statement of residence is probably a very good idea. It gives notice that you are not bound by their laws, as you are a temporary visitor, and it tells them what your personal feelings are in a matter of emergency. I think, just because of this, I'm going to get the state form and fill it out for us. Just in case. You never know.

Guest guest
My guess is that carrying a religious exemption out of the country has to be irrelevant. It is only a legal instrument in the U.S. and only if a state accepts religious exemptions, and only if the exemption conforms to the intent of the law of that state. I suppose it doesn't hurt to have - it might create the impression that the power of the U.S. or at least a U.S. state backs it up. But unless you think they will refuse to treat you, I can't imagine a foreign country would force you to vaccinate. Could they deport you? Although I agree with Phyllis that we should be prepared, sometimes there are real emergencies, so it doesn't hurt to have a legal strategy to deal with such things. Anyone? And if, as a CITIZEN of Minnesota you have the right, whether religious, philosophical or otherwise, to not vaccinate. That is your right, no matter what state you're traveling in. Illinois can not take your rights away, just because you happen to be visiting, as long as those rights don't infringe on the rights of others who are under their jurisdiction. I don't think vaccination of your children qualifies, and if they think it does, they'd have a heck of a time proving it in court (actually, I'd like to see that one). Guest guest
Sheri, And the idea that they could threaten - even if there was no basis for their threat - resulted in people vaccinating their children who would not, apparently, have done so otherwise. Guest guest
I don't know the specifics of the case you've mentioned, but I can say how our state has handled this - maybe this will give some insight. Although I homeschool my children here in Montana, the state law requires that I maintain immunization records and, in addition to attendance records, I must be prepared to present this information upon request to the county school superintendant. Maybe this is the loophole that states use to scare us into immunizing our children. I am working on a religious exemption letter that I will maintain on file should I ever need to provide this to the county. > I'm still confused, however, about the need for those parents to have provided any information, if they had removed them from school. The vaccine mandates, as Sherri explained, is a SCHOOL BOARD issue. the state can set guidelines in accordance with those issues, but they can NOT dictate that you HAVE to have chemicals shot into you in any way, shape or form, unless you have been declared incompetent to make such a decision. Additionally, you are entitled to public schooling. How do they get away with it? Simple, scare tactics. Those people in Utica need to hire a good constitutional lawyer, and there are a few. One simple way to solve it is pull your kid out of school, of couse, I would regard this as passive, I myself prefer the stand up and be counted methods - whereby other people would see the situation and go " hmmmm? " . Here is an example, non-vaccine, but you can see that the state can only force you to do so much (and actually, they can't force you to do anything unless it infringes on others' rights)... My mother went into cardiac arrest in June. I took her to emergency where it was determined that her lungs were failing. They needed to intubate her before they could administer any tests or drugs. She refused. They complied. All it was, was a tube to bring her oxygen up to 80% or better. They felt, that because she had answered the questions (2 of them) correctly and in an apparent coherent manner, that her wishes were to just suffocate right there. It took me 2 hours to convince them that they needed to ask the right questions in order to determine whether she understood what they were saying. Finally, an intern went back and talked to her -- and, as I suspected, realized that she thought they were going to put her on life support. However, the issue is: they withheld treatment, because oxygen in this situation was a drug, something manufactured which must be administered (as opposed to air), and therefore, she had the right to refuse, irregardless of the outcome. Had she been unconscious when I took her in, they would have let me decide. I think Sherri can explain better what happened in Utica- but usually, when peoples' rights are stepped on, it means they didn't follow proper administrative procedure to ensure those rights. It can be very complicated, and if you mistep, you buy the boat, so to speak. One other thing that I found when perusing our statutes... Some of these " laws " are not laws at all (enacted by the state senate by vote), they are actually guidelines set up by the various state departments (such as health). There are a lot of things you must research and read. Never assume that just because someone said it's the law, that 1. it is, or that 2. it must be followed. One of the basic rights of juries, for instance, that never gets brought up, is that they are to determine if the law supposedly broken, was broken, and if so, was it a just law? Our school system has sent home two flyers this year. Both said " Vaccinate your children. Save them from possible death. It's the law " . Big lie. Big, big, lie. And I have letters into the Attorney General concerning the language (veiled threats) used to get parents in to do something they may not want to do -- but because they don't know their rights, they will because education is important. Very few people in this state know that they don't have to vaccinate their kids. And because the system received federal funding, the school can't require it either.
