I'm not really interested in actually pursuing legal action against him; the

most I would do is file a police report if he did end up refusing to return my

serum or medical records, etc. I'm really hoping that DOESN'T happen, though!

As for the unexpectedness of it all, I'm really trying to figure it all out.

Both of the messages I listened to were the doc's own voice, so he's not in a

coma in a hospital somewhere. He sounds completely normal on the machine, and

says that he will see patients on a limited basis for 'urgent' situations until

June, plus filling 'urgent' scrips until then. He's not married any longer and

he doesn't have any kids (at least no kids that I've ever heard of... I guess

you never know about someone's wild oats though, huh?), so I don't think it's

that an immediate family member has taken ill. And it seems like if it were

some sort of " unexpected emergency " , he would have had at least ONE of his staff

members stay behind to man the phones, call people to tell them that their

appt's have been cancelled and they need to find a new family doctor, and

forward medical records, etc.

The only thing that makes any sense to me is if he just went bankrupt... if he

kept thinking he would find a new funding source, etc., but it just didn't come

through for him and he couldn't even afford to make payroll all of a sudden.

He's a fairly young doctor (maybe 38-40yo), and he just went out on his own

three years ago (and went through a divorce at the same time), so he has had

some pretty major expenditures: office space to be renovated, office equipment,

medical equipment, insurance coverages, etc. Previously he was employed by a

well-established group practice (in which he was an employee, not a partner)

that was staffed with almost a dozen doctors. In his own practice, it was just

him " bringing in the bacon " -- an office with 2-3 employees (plus the doctor's

salary too) and three fully-equipped exam rooms is a LOT of overhead for just

one physician's billings to cover, so it may be that he simply got overextended

and couldn't get out from under it. That seems to be the only plausible

explanation for why he doesn't even have his receptionist anymore.

As long as I get my stuff, that's what really concerns me. Here I am getting

ready to go in to see the new doctor, and I can't even tell him for sure what my

TSH levels were for the past decade, b/c my medical records are all being " held

hostage " by the AWOL doctor!!! VERY frustrating, but I'm looking at the bright

side -- maybe this is all for the BEST, b/c it forced me to seek out a new

doctor (one who can and will help me figure out my hormones!) :o)

I had something similar happen to me years ago, when my PCP joined an

HMO, but he at least made a token effort to refer me to colleagues. Your

legal options are limited and probably not worth the effort and expense,

unless (a) those allergy shots were REALLY expensive or (B) the

abandonment directly causes you some major harm, such as

hospitalization, surgery, or financial loss. However, you can report the

physician to the appropriate governing medical board. That might turn up

the heat a little.

Since this is considered such seriously unprofessional behavior, you

might be dealing with a sudden illness or other situation that

incapacitates the doctor. You might want to ask around and see if anyone

knows why this happened. It might help you decide whether you want to

cut him some slack or try even harder to find the nearest lawyer.

This happended to me with my OB/GYN. Thank goodness it was for a

physical when I found this out.

Years later it came to light that there was a malpractice suit

against him and he was tired of dealing with those. He simply

retired and said the heck with it.

I don't know what happended. My dealing with him were excellent. He

naturally delivered a very difficult baby and successfully treated me

for infertility. Hard to say what went wrong.

Well, I know my request made it into the computer today for them all to see, but the GI Doc still didn't call. At what point do you suppose I could start flinging this lovely word around, am I expecting too much, too soon? I find it mighty odd that they are refusing to let me make a return appointment. He has had the Cat Scan results since November 22nd.. Seeing another GI was not mentioned, except by my Primary and he said I would have to start over at square 1 with a consultation, at least an 8 week wait.. Treatment.. Thankfully I saw a second opinion doctor and started on Supplements in October, she has at least, I am very sure bought me more time.. I will be lucky to get started on tx as soon as , the way things are going.. I am also Geneotype 1... Sheena

Sheena I'd be flinging it around right now!!! Abandonment is a very serious issue and if you were to suddenly get worse, and he refused to return your calls, his NEGLIGENCE could cause you further illness.. For a doc to be found guilty of Negligence, there are 4 things required 1. The doc had a duty to respond ( he does because he is your doc of record at this time) 2. He didnt respond 3. You became worse, or had something bad happen to you 4. The bad thing happened to you BECAUSE of his lack of responding.. Remember honey, this disease moves in decades,, you do have time to find a new doc but since he was your doc when they found the tumor.. so he HAS to deal with it,, I mean, he might send you to a surgeon or some specialist but he still NEEDS to call you back I'd call the AMA immediately and report this... I'd also call the better business bureau and report

him too. Hey no worry hun , I am getting used to dealing with wacko's . I had one doc refuse to do a gastric procedure on me cause they said it would transmit the hep c . And another one told me that hep c doesnt kill at all . And I saw these doc's within the last 3 yrs . I used to have an HMO , what you have to do is get the doc to appeal any denials that you have gotten for treatment . Remember honey, this disease moves in decades,, you do have time to find a new doc but since he was your doc when they found the tumor.. so he HAS to deal with it,, I mean, he might send you to a surgeon or some specialist but he still NEEDS to call you back I'd call the AMA immediately and report this... I'd also call the better business bureau and report him too. Yeah that's the trick , you just dont let them get away with denials . Fight fight fight , there is always ways around denial's.
