It is not clear by your message on what ground the aid offer was declined by India. Our Society is working in the field of evolving ethical and legislative strategies relating to HIV/AIDS in India. It is a combination of medical and legal professions. You are right that human health is a state subject in India, but the Indian constitution contains distinctly positive provisions in order to protect and promote human health and these provisions being the directive principles of state policy are uniformly binding on all the States of Indian union. The Hon'ble Supreme Court of India, the highest judicial forum of the country, has declared health as an integral part of right to life and as such it is the state's liability to ensure sound health to all its citizens. HIV/AIDs being the major health hazard fall with in the ambit of state's health care responsibilities.
