I have read the provisions of the Social Security law that deals with working part time but they seem very ambiguous. I was even more leery when I called the Social Security offices, on at least five occasions, and received no less than five different opinions as it relates working while on disability. In reading the section of the law, it states that there is a threshold of income that determines your ability to work and also qualify for SSD. But there is also reference to being able to achieve a level of " substantial gainful employment " that is used for determining eligibility. In essence the kind of work you are performing. Example, being disabled you can do light clerical work, earn less then the threshold, and not raise any flags. However, work in construction, earn less then the threshold, and raise some red flags, rightly so in my opinion. But therein lies the question, that gray area in between. When can, legally, the Social Security Administration deem that a person is conducting " substantial gainful employment, " and be cutoff from receiving their benefits? I through many conversations with Social Security staff can tell they are not even sure of the exact policy on this issue. I spoke with an attorney, a specialist in the SSD area, and of course there answer was " don't worry, we will litigate and return the benefits. " It is too difficult to even get approved to receive SSD, the risk of being terminated in my mind would be just as traumatic and stressful, if not more.
