I have recently applied for Disability Insurance and my Doctor and

the Doctor that Social Security sent me to both seemed to think with

the loss of use of my hands alone (I also wear AFOs) that I would

probably be accepted. I am not even able to touch my right thumb to

the last two fingers of my right hand. Well I was not and now I have

the option to ask for a hearing. But it sounds like they want more

information. Does just seeing me personally for themselves help or

should I get a lawyer or representative? Any advice?

Deanna, do it yourself. My son was denied and I had to appeal. The judge

decided he needed another medical opinion. I requested a pediatric

neurologist that was knowledgeable in CMT . The judge was so sweet about it

all. After my son saw the new doctor he was approved. Keep trying Deanna. It

gets frustrating I know.

It is entirely possible that your neurologist and physical therapist

did not submit your medical records to the Social Security Office

where your application was filed. How many medical release forms did

you sign? Because in order to get ALL your records, one release form

has to go with each request. Assuming you did that, then right away

file a Request for Reconsideration Form 561-U2 (download on your

computer) http://www.ssa.gov/online/ssa-561.pdf and take it upon

yourself to get copies of your neurologist and physical therapy

files, copy them, and send by certified mail/return receipt

requested. In your Request for Reconsideration Form state that " I do

not agree with the decision, and wish to be reconsidered based on

additional medical documentation I am enclosing " .

RECONSIDERATION: A reconsideration is a complete review of the claim

by someone other than the individual who made the original decision.

All evidence, plus any additional evidence submitted, will be

reevaluated and a new decision will be rendered. If an individual

disagrees with the reconsidered decision, they can choose to go to

the next level of the appeals process.

At the Reconsideration level, you might not need an attorney.

However, if the Recon is denied, then an attorney will be
