Our school system does have a SpED policy manual, but the only way I got to

see it was to borrow it from a SpEd teacher and make my own copies. When I

asked the chair of the SpEd dept., her reply was " I don't think I can do

that! "

Geesh! And I work in the school! Looks like we have to get things via

Freedom of Information Act!

What better could you ask for. They will follow the absolute minimum

compliance, but they do not recommend breaking any administrator's

rulings or laws .. right up to the top.

My heart goes out to the parents dealing with this. Why don't we have a

clear statement of how we will define who gets the needed support and

how it will be delivered. SC seems to be 'meeting minimum requirements'

... which is equivalent to a 'U' or unsatisfactory on your kid's report

card.

This is typical. Where districts have specific policies and procedures

spelled out, they are typically verbatim quotes of federal and state

regs--even to the point of quoting lines like the " local district will have

policies and procedures in place " with no mention of what those might be.

Learn your state and federal regs well. Most states have them on-line or

will send a copy on request. Fed regs are at

Sometimes too, there is a sped handbook (usually for teachers, not parents)

that has some district policies and procedures/guidance. You would have to

know to ask for it; maybe FOIA for it.

Freedom of Information Act-you can ask for copies of public documents (may

be a charge for copies).

Where can I find a copy of this law? I have asked for my kids school records

and my request is being ignored. I really do want them, and know I am entitled

to have them. I just don't know chapter & verse of the law to insist on getting

them.

This isn't the law you want for your child's school records. You are

entitled to review your child's records through IDEA and the federal and

state regulations for sped. (see fed regs link and the state regs link

Cheryl gave). FERPA (yet another law) also involves parents' right to

child's records. This is also called the Buckley Amendment:

Have you made the request to review in writing? If not, that might be a

last step before waiving a potential compliance complaint, FERPA complaint,

or other action. Be aware that review is the primary right and that your

district may ask for fees to copy the records.

Do you know a new Cochlear policy took effect yesterday? For example, I have

bilateral CIs. If I need to send one back to Cochlear for repair, they will

send me an envelope to send the CI to them. Then they will try & return that

CI within 96 hours. They are no longer sending temporary CIs, so this meand

relying on the other CI & /or back up 3G/Body unit. The reason for no longer

sending temporary CIs is because users were not returning them to Cochlear

upon receiving their repaired CI. Shame on those folks who made this more

difficult on those who did return the temporary CI.
