Unfortunately, the innocent in these cases inlude the child, and as with the SCRAM bracelet, EtG does take children away from parents who are complying. Nothing boils my blood more than a parent losing a child, a child losing a parent because the parent cleaned their child's dwelling. EtG is probably worse than the bracelet because there is no certain time of consumption which does increase the posibility of a good defense. I would suggest neither!

Hi Larry and welcome to our happy little family! The GOOD news is that you know the cause of this positive test. The BAD news is that you face 16 more years of having your sobriety measured with this lousy test. Can you fight using the EtG test by presenting the SAMHSA advisory to the court? [it specifically states the following: "Currently, the use of an EtG test in determining abstinence lacks sufficient proven specificity for use as primary or sole evidence that an individual prohibited from drinking, in a criminal justice or a regulatory compliance context, has truly been drinking. Legal or disciplinary action based solely on a positive EtG is inappropriate and scientifically unsupportable at this time.] This isn't the first time TASC has been mentioned on this board with regards to the Arizona family court system. I suppose that

until somebody challenges them in some long, expensive legal battle, they will continue to bully people with their ignorance. sensitive to any thing with alcohol in it and asked if I could think of anything that might contain alcohol that I had consumed. As I thought about it I had drank 3 or 4 nonalcoholic beers on Sunday, and I tested on Monday. It does contain a small amount of alcohol and that is what caused my positive test. I started looking into the ETG test and was shocked to find out all the different things that can make you test positive. It concerns me very much because basically I have to abstain from alcohol for the next 16 years. The court gave my ex the right to test me 4 times a year randomly, until my son is 18 years old. Believe me she will test me 4 times a year until then. If I am positive I lose the right to see my son until I have completed 8 weeks of random testing. So I asked my lawyer to get me a list from the lab or the courts of what I need to be aware of that can cause me to test positive, so that it doesn't

happen and guess what, there isn't such a thing. I am very frustrated with this whole topic and is nice to be able to vent to others in my same position. They have to realize that they are tagging innocent people. Thanks for listening.SincerelyLarry

Lorie, I did find the SAMHSA report on line and faxed it to my lawyer, which he agreed that it could possibly be a plus in court.Problem is my dirt bag lawyer would put me in the poorhouse doing it. I spent 30K just trying to get divorced and partial custody of my son and can't afford to fight the court system. Catch 22. Thanks for your reply.
