Thanks for the info, I am not working now. You are the

1st person that I have heard get prosecuted by the

county. Can I ask what the charges where for? Did

your work want to prosecute or was someone else? I

was just talking to another nurse in my support group

and she said when the investigator came out she told

him every thing, she diverted from work. No charges

were filed. But then again as I am finding out nothing

ever goes as planned, I would of never thought I would

be in the etg nightmare. I always thought opiates were

my enemy not etg

I diverted from my workplace and spilled my guts to the investigator.

Criminal charges were not filed and, as I understand it, that was

because my employer did not choose to file charges. I know of others who

did exactly what I did and their employer chose to press charges and

have them arrested.

My employer didn't file charges against me, they just filed a comlaint with the BRN. When I spilled MY guts to the inestigator, he initiated the filing of charges against me. I was "lucky" and got my "record" expunged upon completion of their "program". Then probation took over. I was never arrested--just got a letter in the mail from th DA's office telling me to appear in court.

--- I think the " arrest " record stays. You should do a background

check on yourself to see if it comes up. Don't let it surprise you

somewhere down the road. This is what I am always screaming

about....the war on drugs causes people more harm than the drugs

themselves. You may be explaining an arrest record for the rest of

your life just cuz you took a little dope.

Thanks for the info, Madison--it really got me thinking. I called my daughter, who it so happens is a major accounts manager for a company that does background checks nation-wide. She really gave me a lot of insight and is going to do all she can to guide me in the right direction to make things "look as good as possible". I hadn't discussed it at all with her because she didn't even know that I was criminally charged. I didn't trust her with the information as we have issues and I didn't trust her with this information. However, we have grown closer and worked through a lot of our issues--that's part of recovery, isn't it? I'll let you know how it goes. Thanks for the support. yup you are right it goes to the FBI..if you were convicted or not ...its always there..I know cause about 30 years ago I rescued my dog from he pound and the judge threw it out...and it can be used against you..glad I was never arrested doing civil disobedience at peace rally's and anti nuclear rally's years ago..I did live with the yippie's on Bleeker street 30 years ago too..so they might have me there..Ya gotta be careful now with the new bill that the chimp signed this week...

I'm not sure I know the answer to that. I'm sure that in diversion or probation you sign a contract and agree to have them give permission for anywhere you work. If you break that contract, they eventually find out and take your license away. Between diversion and probation, you can use your license freely. Maximus only tells your current employer.

Thank you " lftbhnd007 " , " Robin Murray " , and " Amy Mills " for your

great advice and information.

This has been very helpful for me. The reason I was asking these

questions is because I do not have much trust in drug tests. I

think when peoples' lives are in the hands of a drug/alcohol test,

it should be 100% accurate and nothing less.

A few years back, when I was tested anywhere from 3-12 times a

month, I was givin a " dipstick " test for THC. I failed it. I had

not used marijuana. I was then placed under arrest, and taken to

jail. (I had nobody to bail me out... Not even my father !)

After 3 days, I was released. I asked her why and she said they had

sent the urine to be tested in a lab, which they never do, but she

knew I would fight it in court.... The test came back negative.

Ever since then, I have not had much trust in the tests... I would

have lost my job, failed out of school, and been in prison for God

knows how long....

I intend on using this information to inform the probation office,

judges, and whoever else I know that relies on these tests to make

such life-changing decisions for peoples' futures. I also plan to

send this to Asa Hutchinson. Asa was a lawyer that worked for my

dad. He was head of the DEA, started the " Drug-court " treatment

programs around the US. He has recently changed positions, but still

contributes to the control of these programs.

The problem is, most law enforcement officials do not realize that

these tests have flaws. They assume that they are 100% accurate, as

I did. (Until I failed one and did research.)

As for you and Amy... I did not get much help from your

messages. What a way to welcome a person....

And " Daddy " hasn't always fixed it for me. I've done my time, many

of times... I have been very lucky and fortunate to have him as my

father. Only thing he has done is kept a felony off my record.

Glad you found us! Seems the AG is catching up to you and a few others

who dropped out of Diversion b/c of this. The good news is the SAMHSA

advisory should prevent them from using EtG results to discipline you.

I'm guessing, however, that you may have to sign a probationary

agreement. I just hope you don't have to waste a bunch of money on

attorney fees like I did. My atty submitted a letter to the AG office,

along with the SAMHSA advisory, and they reached a settlement agreement

a few days later. It made all the difference in my case. According to my

lawyer, the evidence against me (positive EtG results) would almost

certainly have been excluded from my hearing.

So Lorie, what is your status now with your license, etc.? Since a settlement

was reached

and you won't have a hearing, are you DONE with these jackasses then, or are you

still

completing a probation or whatever? Are you able to practice again? Sorry if I

missed

someting...I am impressed that the SAMHSA advisory was submitted and actually

regarded

as something serious in a court of law! (not that it shouldn't be, just that

with the way the

boards are reacting to it I was getting really discouraged...)

I will be starting a brand new 3 years of probation when the board signs

the agreement. When Maximus gives me their blessing, I will be permitted

to hit the pavement and find a job. My intake eval is next week. I'm

sure my " sobriety date " will be whatever date they desire. They are

still under the impression that I relapsed and am a sick, sick alkie in

denial.

Whoooah, so even though they admitted there was evidence enough for them to

" settle, "

they are still making you start all over again? I'm not trying to get you riled

up or anything

but doesn't the court thing mean ANYTHING to Maximus and how can they still

think you

relapsed if they threw out the etg thing in the legal world based on the

advisory?

Especially after your self inflicted in-pt rehab experience with the +etg? Do

they just get

to blatently disregard all that? (What did Maximus say to that anyways???) I do

not

understand any of this...And please correct me, but I presume that you are

starting

probation because you are no longer with Maximus; (?) did you actually " quit "

diversion

with them, and if so, why do you need their blessing to find a job or be

subjected to THEIR

twisted interperetation of your sobriety date? (If now it falls under

" probation's " rules?)

Like I said, I really am not trying to piss you off, but this is why I am very

discouraged with

the whole " advisory " thing, cause those who are still governing our lives are

just taking

this like " take or leave it " attitude, which if this had any weight legally how

can they do

Amy, I've lost 5 months + over $30K in attorney fees + 18 months (and

counting) in wages (my license has been suspended since May 05). We have

no committee or 'face to face' with anyone. They can read us

telepathically through the phone lines I guess.

Unfrickinbelievable. I give you a LOT of credit for remaining as sane as you

are, stuck in

this system which is so clearly f*ck*d...I hope what comes around really goes

EXPONENTIALLY, that's all I can say. People have told me, " remember, if it

weren't for the

decisions YOU made, you wouldn't be in this mess... " (don't you LOVE that?)

And while,

yes, this may be true, it doesn't mean we should be treated like violent

criminals, etc. My

ex-husband pointed out to me, " do you realize that prisioners in jail have more

rights than

you guys in diversion seem to? " So the lack of face to face, well what should I

have

expected from any of them...I guess they can tell telepathically through the

phone if you

relapsed or not too... I guess for right now it will have to do to just know in

your heart

that you are the better human being, and hope that karma really exists...

That was a good one Lorie!

That has been one of mMAJOR complaints with the Pharmacy diversion process, that we do not have face to face meetings with these people. I think that is a MAJOR contributor to their inaccurate judgements of us.

Carolyn...sounds like you are in diversion not probation? Probation

does not have transition. Also, when I spoke with the investigator,

I confessed all....wanted to be done with the whole mess and was

working an honest program. I did not have any legal issues come up,

was told it was over the statute of limitations. Just my experience.
