Hi Amy,

It is possible that they can require this. What is legal depends on the answers

to several questions, including " When was the building built? " , " Did it use

public funds? " , " How many units does it have? " , and so on.

I would call your local Center for Independent Living (CIL) to get your answer.

Tara says that you live near Amarillo. There is a CIL in Amarillo and the

Your best option is the 1988 fair housing act. It specificaly

provides for " resonable accomodation " . If the ramp you need does

NOT put undue financial hardship on your landlord they are obligated

to provide it for you. You must send a letter to your landlord

asking for the accomodation and stating why it will provide

you " enjoyable " use of your home. I have sample letters if you need

them. Many other sample letters are available on the web. If you

write a " request for Accomodation " you can put a deadline on it such

as 10 days. This is recommebnded by the US Department of Justice.

If they do not respond you can file complaits with many agencies.

I.e. DOJ, HUD, EEOC. You can easisy get there undivided attention

if you want.

Do a google search " Reasonable accomodation in housing " and you will

see lots of great leverage to help get what you need.

If the ramp is VERY expensive in relation to the total revenue

generated by your building then it will be a difficult uphill battle.

Hillary has answered this question very thoroughly!

Here in NH as a rule, this would be correct. It may vary from state

to state. So I would also encourage you to contact the ILC that

Hillary had forwarded the information. Also I would encourage you to

contact the ADA Technical Center at 800-949-4232

Also if you find you are not able to pay for this ramp or lift, I

would encourage you to contact the same ILC for funding resources!

That is awesome that they are willing and able to make adjustments

in your home! It's funny how some places thinks this is a luxury

rather than a necessity...

I did contact them both.. they said if the building was built before 1990

then it doesn't have to be accessible. Only the manager's office, etc. The PILC

said to phone them next week and they would like to speak to me about getting

me some help with a ramp being put in, etc. So we'll see.......

Huh?? A.D.A. will still apply. They have to be compliant. If they start to

get pissy when you tell them by Federal law they have to be ADA compliant

email me off list with thier information and phone number I have someone who

will tell them the ins and outs of the law :)

(Also may I forward your original email amy to my friend who is the ADA

expert?).

Ames -

The ADA may or may not apply. That's why you have to answer those

questions and more, and then consult with a housing expert - this may be

subject to 504 laws, or the Fair Housing laws. You really need to gather

more information.

Again, my suggestion is to contact the place I listed in my earlier e-mail.
